İslam Borçlar Hukukunda Niza
İslâm borçlar hukukunun önemli kavramlarından biri olan niza; (anlaşmazlıktan dolayı çekişme) özellikle Hanefî mezhebine göre, cehâlet ve cehâlet kaynaklı garar gibi hususların akdi fesâda götürmesindeki belirleyiciliği çerçevesinde incelenmiştir. Niza, akitte söz konusu olan bir belirsizlik nedeniyle, taraflardan her birinin haklı olduğunu iddia ettiği, eşit gerekçeli bir anlaşmazlık durumudur. Bu çalışma, dört mezhebin fürû kaynaklarından kavram taraması neticesinde elde edilen verilerin işlenmesiyle ortaya konmuştur. Yapılan incelemeler, niza kavramını ortaya koyup geliştiren mezhebin, fesâd teorisinin de bir sonucu olarak, Hanefîler olduğunu göstermiştir. Hanefîlerin belirsizlikle ilgili her meselenin hükmüne karar verme noktasında gerekçe olarak nizayı öne sürmeleri bunun en büyük göstergesidir.
