The increasing number of executive tasks assigned to EU institutions and agencies has resulted in a greater demand for justice that can no longer be satisfied by the courts alone. This has led to the development of a wide range of administrative remedies that have become a central part of the EU administrative justice system. This book examines the important theoretical and practical issues raised by this phenomenon. The work focuses on five administrative remedies: internal review; administrative appeals to the Commission against decisions of executive and decentralised agencies; independent administrative review of decisions of decentralised agencies; complaints to the EU Ombudsman; and co...

Key Ideas in Administrative Law

  • Categories: Law

This book offers an accessible critical introduction to administrative law by reference to a number of key ideas which characterise administrative law. By way of introduction the book considers the different theories that have been advanced to explain administrative law, including their explanatory strengths and weaknesses. The book considers the question of scope, that is who is bound by administrative law principles. The book then examines the obligations imposed by administrative law, including consideration of who has standing to sue for breach of these duties and the remedies available for breach. These obligations can be grouped per two key ideas. First, public duties: these are duties...

Soft Law and Public Authorities

  • Categories: Law

This book considers the phenomenon of soft law employed by domestic public authorities. Lawyers have long understood that public authorities are able to issue certain communications in a way that causes them to be treated like law, even though these are neither legislation nor subordinate legislation. Importantly for soft law as a regulatory tool, people tend to treat soft law as binding even though public authorities know that it is not. It follows that soft law's 'binding' effects do not apply equally between the public authority and those to whom it is directed. Consequently, soft law is both highly effective as a means of regulation, and inherently risky for those who are regulated by it. Rather than considering soft law as a form of regulation, this book examines the possible remedies when a public authority breaches its own soft law upon which people have relied, thereby suffering loss. It considers judicial review remedies, modes of compensation which are not based upon a finding of invalidity, namely tort and equity, and 'soft' challenges outside the scope of the courts, such as through the Ombudsman or by seeking an ex gratia payment.

The Administrative Process

  • Categories: Law

An introduction to the study of administrative law. The word "selective" is used advisedly. The focus has been on a small number of cases-mostly Supreme Court decisions-that the authors regarded as particularly important or interesting. Some, but by no means all, of the relevant recent literature has been noted.
