En este libro, de tinte divulgativo, se introduce al lector en dos métodos de estudio del derecho: uno que ya tiene cierto andar, como es el caso del análisis económico del derecho (AED); y otro de factura más reciente, que es el análisis conductual del derecho (ACD). Pero ello no es todo, porque ese caudal de herramientas conceptuales y multidisciplinares se vuelca -luego- al ámbito específico del derecho procesal, dando nacimiento, así, a lo que se ha dado en llamar análisis económico y conductual del derecho procesal (AECDP). A partir de este último se ofrece un nuevo punto de vista desde el cual analizar el derecho procesal, que se centra en la conducta que es observada por todos los que intervienen en un procedimiento judicial, sea como partes, como jueces, e incluso como terceros. Lo que resulta de suma importancia, porque es aquélla, precisamente, la que se busca regular a través de las normas procesales. Y porque no debe olvidarse que el derecho, a final de cuentas, pretende una sola y única cosa: moldear el comportamiento humano, esto es, regular, incentivar e impulsar a los individuos para que actúen de cierta manera y no de otra.
