Fundamentos del derecho penal
El doctor Alfonso Zambrano Pasquel en su obra "Fundamentos del Derecho Penal" luego de hacer un deslinde del concepto del derecho penal en sentido objetivo, el delito y la pena, nos conduce a los principios limitadores del derecho penal y en ellos, profundiza respecto al principio de mínima intervención penal que en su criterio, no debe significar impunidad sino la contracción al máximo del sistema penal, y su utilización como recurso extremo y a falta de otras respuestas. En tal sentido podemos señalar que es subsidiario porque su legitimación depende solo de que entre en juego en defecto de los otros recursos jurídicos del Estado, al no bastar los controles extrapenales, ya que el derecho penal debe actuar solo en último lugar como última razón (última ratio). Por su enorme gravedad o daño, la sanción penal no solo ha de ser el último recurso jurídico, sino también el último o extremo recurso social.
