Hans Kelsen and the Natural Law Tradition provides the first sustained examination of Hans Kelsen’s critical engagement, itself founded upon a distinctive theory of legal positivism, with the Natural Law Tradition. This edited collection commences with a comprehensive introduction which establishes the character of Kelsen’s critical engagement as a general critique of natural law combined with a more specific critique of representative thinkers of the Natural Law Tradition. The subsequent chapters are then devoted to a detailed analysis of Kelsen’s engagement with prominent theorists from the Natural Law Tradition. The volume concludes with an exploration, focusing upon the delineation of a non-positivist legal theory in the debate between Robert Alexy and Joseph Raz, of the continued presence of Kelsenian legal positivism in contemporary legal theory.
English summary: Armed conflicts such as the Yugoslav Wars are grave examples of the limits of international humanitarian law. Andrea Bindig focuses on Ernst Cassirer's philosophical concept of symbolic form to depict the partly self-contradictory meanings of normativity which shape our path to civilization. This study presents the Paris Peace Treaties of 1919-20 in a new light. Going beyond conventional narratives about the "dictated" peace of Versailles and the failures of the peacemakers, the book offers a fresh and comprehensive look at the five peace treaties with Germany, Austria, Hungary, Bulgaria and the Ottoman Empire. Marcus Payk exhibits the influence of late 19th century normative expectations and demonstrates how the entire peace settlement was deeply imbued by notions of international law, justice, and legality. The study examines the political power as well as intrinsic logic of legal arguments in foreign affairs, arguing for a more nuanced picture of a juridification of international politics.
"Haltern's Europarecht is a landmark in German European legal scholarship and education which will surely be copied in other legal disciplines. (...) In the eyes of scholars and students, his book is simply Europarecht. All others are Dogmatik ohne Kontext." Joseph H.H. The O.C., A Critical Understanding, by Lori Bindig and Andrea M. Bergstrom, is a feminist cultural studies analysis of FOX’s hit teen television drama The O.C. (2003-2007). Episodes of The O.C. are analyzed as a set of media texts that blur the boundaries between hegemonic and counter-hegemonic content. This analysis utilizes ancillary media such as director commentary in conjunction with content in order to understand how ideological content, in regards to gender, race, class, sexuality, and consumerism, is presented throughout the show. The O.C. is also examined in terms of audience analysis, auteur theory, aesthetics, and reality television spin-offs. Bindig and Bergstrom place The O.C. in a larger social context and explore the potential ramifications of popular media texts, as well as the series' cultural legacy which continues to resonate in media and culture.
