Angesichts des andauernden kriminalpolitischen Diskurses sowohl um die Legitimität des Straftatbestandes des Sportwettbetruges (§ 265c StGB) als auch um den – möglicherweise rein symbolischen – Aktionismus des Strafgesetzgebers allgemein setzt sich die Autorin kritisch mit dem Straftatbestand des Sportwettbetruges auseinander. Sie untersucht, ob er ein legitimes strafgesetzgeberisches Tätigwerden darstellt oder ob er schließlich – wie von Kritiker:innen behauptet – als Ausfluss eines rein symbolischen Strafrechts einzuordnen ist. Als Maßstab dient die Begründung des Gesetzentwurfes der Bundesregierung und damit die gesetzgeberischen Zielvorstellungen. Der Gesetzgeber wird an seinen selbst gesteckten Zielen gemessen.
