La sentencia del Tribunal Supremo de 13 de mayo de 2010 ha utilizado como elemento sustancial de su razonamiento jurídico en un caso de revocación por causa de ingratitud la regulación que del "contrato de donación" se contiene en el Proyecto (académico) de Marco Común de Referencia para el derecho contractual europeo. Esta monografía estudia críticamente la regulación de la donación en el Marco Común de Referencia, confrontándola con el derecho español. La comparación es útil para colmar algunas lagunas en la construcción contractualista que la doctrina mayoritaria hace de los preceptos relativos a la donación del Código Civil, no solo en materia de revocación, sino también de las obligaciones tanto de donante como de donatario y de los remedios de que disponen respectivamente en caso de incumplimiento.
