El origen de la expectativa razonable de privacidad se encuentra en el caso Katz de 1967 del Tribunal Supremo federal norteamericano sobre la Cuarta Enmienda. Ante la posibilidad de vigilancia tecnológica sin necesidad de acceder a la propiedad del afectado, el Tribunal Supremo amplió la protección a la privacidad.
