According to mainstream economic thinking, inspired by the ideas of Smith, Ricardo and others, globalisation of the world economy is profitable. But unlike these classic writers, neoliberal economists pay little attention to the moral and social consequences of economic policies. Despite the fact that present social circumstances differ a great deal from those in the time of Smith and Ricardo they keep maintaining that “an invisible hand” will further social ends. In doing so they ignore growing poverty worldwide and the exclusion of countries from the international legal order and of people from the right to social participation and freedom. This book pays attention to economic aspects of globalisation and also to philosophical, legal, social, cultural, ethical and ecological aspects. Its aim is to contribute to possible solutions for worldwide problems that accompany the globalisation process.

Among the aims of the United Nations Decade of International Law is the promotion of the means and methods for the peaceful settlement of disputes between states. In the previous volume, The United Nations Decade of International Law, Reflections on International Dispute Settlement, the editors contributed to this aim by bringing together a variety of opinions by international legal experts on the topic, with an emphasis on the role of the International Court of Justice. This time, the editors turn their attention to international arbitration and the role of the Permanent Court of Arbitration. It also explores the prospects for pre-constituted, non-ad hoc arbitral institutions which may be considered in the general framework of peaceful settlement of disputes between states, as well as between states and other actors (commercial arbitration) in the present day international system, through the process of international adjudication. Like the previous volume, this book is a valuable contribution towards the promotion of the United Nations Decade of International Law.

Dante Fedele’s new work of reference reveals the medieval foundations of international law through a comprehensive study of a key figure of late medieval legal scholarship: Baldus de Ubaldis (1327-1400). A student of Bartolus de Sassoferrato, Baldus wrote both extensive commentaries on Roman, canon and feudal law and thousands of consilia originating from particular cases. His writings dealt with numerous issues related to sovereignty, territorial jurisdiction, diplomacy and war, combining a rich conspectus of earlier scholarship with highly creative ideas that exercised a profound influence on later juristic thought. The detailed picture of the international law doctrines elaborated by a ...

Impediments to the Prevention and Intervention of Genocide

Academics, NGOs, the United Nations, and individual nations are focused on the prevention and intervention of genocide. Traditionally, missions to prevent or intervene in genocide have been sporadic and under-resourced. The contributors to this volume consider some of the major stumbling blocks to the avoidance of genocide. Bartrop and Totten argue that "realpolitik" is the" "major impediment to the elimination of genocide. Campbell examines the lack of political will to confront genocide, and Theriault describes how denial becomes an obstacle to intervention against genocide. Loyle and Davenport discuss how intervention is impeded by a lack of reliable data on genocide violence, and Macgreg...

EU Influence Beyond Conditionality

This book presents an in-depth analysis of the role played by the EU accession process in Turkey’s democratic evolution and in the empowerment of the Justice and Development Party (AKP) in the early 2000s. Often moving against the grain of consolidated analytical positions, the author finds that the accession process can have a critical impact on the political evolution and institutional setting of an aspiring member state that goes well beyond the simple Europeanization process (or EU accession conditionality). In the case of Turkey, that process created the essential conditions and environment for the country’s political modernization by helping the emergence of a “periphery” (incl...

Global Governance and the International Law of the Sea

  • Categories: Law

This book conducts an examination of the international legal regime of the continental shelf through the lens of international relations (IR), with a primary focus on global governance theory. Presenting a new perspective within the field of IR and international law, the book offers new insights into the rules, principles, practices, and actors that establish and govern social interactions and the management of common affairs at the transnational level. The governance framework within the continental shelf can encompass a wider scope than legal laws alone, incorporating informal rules or potentially disregarding formal “black letter” rules that may not be effectively applied in practice....

Humans in Outer Space - Interdisciplinary Odysseys

Humans and space When faced with the issue of space exploration, one generally has an idea of the ?elds of study and disciplines that are involved: technology, physics and chemistry, robotics, astronomy and planetary science, space biology and medicine, disciplines which are usually referred to as the ?sciences?. In recent discussions, the human element of space exploration has attracted more and more the interest of the space sciences. As a consequence, adjacent disciplines have gained in relevance in space exploration and space research, in times when human space ?ights are almost part of everyday life. These disciplines include psychology and sociology, but also history, philosophy, anthr...
