Access to Justice for the Urban Poor

This publication suggests solutions that can be built into the design of urban development projects undertaken by the Asian Development Bank (ADB) to address the common problems and grievances of the urban poor, and to improve urban governance overall. It also identifies succesful or promising community-based approaches to dispute resolution that can be useful in urban project design. It uses ADB's Governance Policy as a framework for analyzing key findings of Access to Justice for the Urban Poor, a regional technical assistance grant to four developing member countries in Asia and the Pacific- Bangladesh, Indonesia, the Hilippines, and Thailand. The findings consist of case studies illustrating typical problems encountered by the poor in connection with access to urban assets and services, and identifies the types of grievances or disputes that may arise because of these issues. The publication reproduces key case studies to illustrate significant concepts.

Ecclesiastes is a strange and wonderful book. It is a strange book because of its startling cynicism and words of wisdom that offer very little of the solace we might expect from sacred scripture ... And yet, Ecclesiastes is a wonderful book, precisely because it is strange. Like Job, and like Jesus, it will not let us fall back on ready answers or take comfort in a religious orthodoxy that satisfies our need for order and predictability. The Philosopher takes us to a place well beyond the limits of our understanding, well beyond our capacity to know and do and control our own destiny. The Philosopher, like Job, and like Jesus, leads us well past the borders of our comfort zones to the place where God -- and God alone -- is.

Identity crime, which encompasses both identity theft and identity fraud, is one of the fastest growing crimes around the world, yet it lacks its own identity: there is no universally accepted definition, little understanding of what the crime is or should be, and no legal framework placing the crime into a coherent and effective grouping of criminal sanctions. In this book, Dr. Syed Ahmed addresses and proposes solutions for resolving these issues and tackles head-on the various facets of what is needed to deal with Identity Crime. A comprehensive and an exhaustive study of different types of Identity Crime is conducted and practical recommendations for preventing and minimizing the impact of identity crime is presented for all to consider.

Nation-Building and Federalism in Nepal

Nation-Building and Federalism in Nepal primarily deals with the presentation and elucidation of identity-based federalism, a unique concept and a novel form of federalism. The most notable source of first-hand information was garnered through the author's involvement in constitution-making by proxy, as a member of the High-Level State Restructuring Recommendation Commission and as a facilitator of several interaction programmes conducted in dialogue form: that is, dialogues with citizens, stakeholders, members of the Constituent Assembly, office-bearers within political parties (intra-party), and leaders across the parties (inter-party). This book, therefore, discusses these issues and helps provide insights into the politics behind the parties' shifting positions on contentious issues related to the constitution at the time of its making; understand better the conflicting aspirations from and competing perceptions of restructuring the Nepali state among the people from different ethnic backgrounds; and capture the role played by intermediate agencies at a critical time of its constitution-making (2006-2015).

The concept of the migrant as rights bearer at law is surprisingly recent and under-developed. Migrants have traditionally been seen as outsiders, persons who are in society but not yet of society. Migrants are at best invitees, ’guests’ for whom presence in a country is a privilege. This is the first of two volumes which bring together writings which trace the evolution in thinking about migrants as legal subjects and rights holders. The articles cover: issues around state sovereignty and migrants as subjects of international law; the articulation of rights; different categories of migrants; issues around health and disability. The volume also features an extended article on the proposal for an International Migrants’ Bill of Rights (IMBR) put forward by an international consortium of academics and students. A related volume Refugees and Rights is also published as part of the series.
