Defusing Default
This book uses a variety of perspectives and tools, including theoretical modeling and cross-country evidence, to examine the costs and benefits of protecting creditor rights. Case studies look at creditor protection in Argentina, Brazil, Chile, Costa Rica, Paraguay and Peru. The studies find that more effective judicial enforcement would help to make more credit available and improve the overall performance of the credit market. (Midwest).
Economic reform in developing countries
This book offers insights into the process of economic reform in developing countries. It is organized around three factors that are critical to the success of any reform. According to Nobel Laureate Amartya Sen, these key dimensions are Reach, Range, and Reason. 'Reach' refers to the ability of reform to be person-centered and evenhanded, reaching all individuals in society. 'Range' considers the institutional reforms and policy changes necessary to implement change and the possible ripple effects on other policies and populations. Finally, 'Reason' captures the importance of constantly asking why a particular reform has been selected.
Taxation of Financial Intermediation
This book examines the options for, and obstacles to, successful financial sector tax reform, both in terms of theoretical and practical aspects. Issues discussed include: the design of optimal tax schemes, the role of imperfect information and the links between taxation and saving, inflation, the income tax treatment of intermediary loan-loss reserves, deposit insurance, VAT and financial transactions taxes; as well as current practice in the industrial world and case studies of distorted national systems. Beyond Common Knowledge
An intensive global search is on for the "rule of law," the holy grail of good governance, which has led to a dramatic increase in judicial reform activities in developing countries. Very little attention, however, has been paid to the widening gap between theory and practice, or to the ongoing disconnect between stated project goals and actual funded activities. Beyond Common Knowledge examines the standard methods of legal and judicial reform. Taking stock of international experience in legal and judicial reform in Latin America, Europe, India, and China, this volume answers key questions in the judicial reform debate: What are the common assumptions about the role of the courts in improving economic growth and democratic politics? Do we expect too much from the formal legal system? Is investing in judicial reform projects a good strategy for getting at the problems of governance that beset many developing countries? If not, what are we missing?
Which way Forward?
The author presents some general lessons in institution-building that has relevance for judiciary reform. She emphasizes the value of simplicity in design commensurate with country capacity, the importance of innovation and experimentation, and of economic openness in effective institution-building. The author underscores how the incentives of individuals depend on both the details of institutional design within the judiciary and also some critical institutions external to the judiciary. Finally she argues for the need to ground reform initiatives on a solid empirical and comparative approach. The author illustrates some of these issues by drawing on a recent project conducted by the World Bank and other institutions.
