Die Reterritorialisierung des Digitalen
In Reaktion auf die Enthüllungen Edward Snowdens und die dadurch aktualisierte Krise der Privatheit tritt die Reterritorialisierung des Digitalen als Reaktionsweise zeitgenössischer Demokratien auf den Plan. Verwerfungen im Zuge zunehmend globalisierter Datenströme sollen nach altbekanntem Muster der territorialen und nationalen Containergesellschaften gekittet werden. Reterritorialisierung adressiert dabei einen digital induzierten Wandel und versucht, Antworten zu geben auf Fragen der gegenwärtigen Neukonfiguration des Verhältnisses von Demokratie und Gesellschaft. Die Kartografie der dynamischen Arena um das umstrittene Konzept Privatheit liefert empirische Erkenntnisse zu einem der meistdiskutierten sozialen Ordnungsmechanismen und zeigt, wie die politische Suche nach Lösungen angesichts der tektonischen Veschiebungen der Digitalisierung mit bestehenden Institutionen, Routinen und Ressourcen verbunden bleibt. The open access edited volume addresses children’s rights and their ability to act in the digital world. The focus is on the position of children as subjects with their own rights and developing capacities. Their consideration by parents, courts and legislators is critically examined. Die Datenschutz-Grundverordnung brachte eine fundamentale Neuordnung des Datenschutzrechts in Europa mit sich. Ihrem Inkrafttreten gingen zähe und komplexe Verhandlungen voraus, in deren Kern die Frage nach einem wirksamen Schutz von Privatheit und informationeller Selbstbestimmung im digitalen Zeitalter stand. In diesen Debatten versammelten sich verschiedene Akteure und Instanzen mit all ihren widerstreitenden Interessen und Problemdeutungen in einer "Arena", um einen geeigneten Umgang mit den neuen Unsicherheiten im Zuge der Digitalisierung zu finden. Das Buch untersucht den Werdegang der Datenschutz-Grundverordnung aus einer interdisziplinären Perspektive. In diesem Werdegang zeigt sich beispielhaft, wie verschiedene soziale Welten mit ihren jeweils eigenen Logiken um die Deutung und Gestaltung von Privatheit und informationeller Selbstbestimmung kämpfen.

Rechtsverträgliche Technikgestaltung und technikadäquate Rechtsentwicklung
Die Projektgruppe verfassungsverträgliche Technikgestaltung führt interdisziplinäre Forschungsprojekte zu Rechtsfragen der Informations- und Kommunikationstechniken durch, die die Ziele verfolgen, Technik rechtsverträglich zu gestalten und Recht technikadäquat fortzuentwickeln. 1988 als provet e. V. in Darmstadt gegründet, siedelte die Gruppe 1998 an die Universität Kassel um. Seitdem ist provet eine Forschungsgruppe am Lehrstuhl von Prof. Dr. Roßnagel an der Universität Kassel und seit 2005 auch eine Abteilung im Wissenschaftlichen Zentrum für Informationstechnik-Gestaltung (ITeG) der Universität Kassel. Der provet e. V. existiert parallel dazu weiter. Im Mai 2018 trat Prof. Dr. Gerrit Hornung als wissenschaftlicher Leiter hinzu. Dieser Band zeichnet die Entwicklung der Projektgruppe nach und will dabei auch als Impulsgeber für ähnliche Vorhaben an anderen Einrichtungen sein.

Die Autoren des Buches untersuchen die historische und sachliche Bedingtheit des Konzepts der informationellen Selbstbestimmung, das zum Zweck des Persönlichkeitsschutzes in der modernen Datenverarbeitung zu einer Zeit und für Umstände entwickelt wurde, die inzwischen längst überholt sind. Thematisiert werden seine auch in absehbarer Zukunft erhaltenswerten Kernaussagen sowie die Änderungen, die in seinem Verständnis und seinen Umsetzungen notwendig sind, um die Ziele der informationellen Selbstbestimmung in einer veränderten digitalen Welt zu erreichen.
