Collective bargaining involves a process of negotiation between one or more unions and an employer or employers' organisation(s). The outcome is a collective agreement that defines terms of employment - typically wages, working hours and in-work benefits. The agreement affords labour protection: minimum wages, regular earnings; limits on working hours and predictable work schedules; safe working environments; parental leave and sick leave; and a fair share in the benefits of increased productivity. The International Labour Organization (ILO) Collective Agreements Recommendation 1951 (No. 91) considers, where appropriate and having regard to national practice, that measures should be taken to...

Working-through Collective Wounds discusses how collectives mourn and create symbols. It challenges ideas of the irrational and destructive crowd, and examines how complicated scenes of working-through traumas take place in the streets and squares of cities, in times of protest. Drawing on insights from the trauma theory of psychoanalyst Sándor Ferenczi and his idea of the ‘confusion of tongues’, the book engages the confusions between different registers of the social that entrap people in the scene of trauma and bind them in alienation and submission. Raluca Soreanu proposes a trauma theory and a theory of recognition that start from a psychoanalytic understanding of fragmented psyches and trace the social life of psychic fragments. The book builds on psychosocial vignettes from the Brazilian uprising of 2013. It will be of great interest to psychoanalysts interested in collective phenomena, psychosocial studies scholars and social theorists working on theories of recognition and theories of trauma.

The Collective Dimensions of Employment Relations

The Collective Dimensions of Employment Relations

This edited volume explores the old and new “collective dimensions” of employment relations. It examines specific challenges stemming from new forms of work of the digital and sharing economy, such as measurement, monitoring, assessment, and remuneration of work, the protection of work-life balance, the impact of new technologies on health and safety, the adaptation of occupational skills to new work processes, and the responses to the digital restructuring of undertakings. It addresses a series of questions such as how the representational action of unions and works councils can adapt to the challenges posed by new production systems and whether the legislative framework needs to be reformed to ensure that digital workers enjoy the right to collective representation. This important collection offers readers a renewed theoretical perspective and justification of the role that the dialogue between workers (representatives) and companies could play in an increasingly complex world of work.

"This intimate, moving, and timely collection of essays points the way to a world in which the burden of grief is shared, and pain is reconfigured into a powerful force for social change and collective healing." —Astra Taylor, author The People's Platform "A primary message here is that from tears comes the resolve for the struggle ahead." —Ron Jacobs, author of Daydream Sunset "Rebellious Mourning uncovers the destruction of life that capitalist development leaves in its trail. But it is also witness to the power of grief as a catalyst to collective resistance." —Silvia Federici, author of Caliban and the Witch We can bear almost anything when it is worked through collectively. Copyright and Collective Authorship

  • Categories: Law

As technology makes it easier for people to work together, large-scale collaboration is becoming increasingly prevalent. In this context, the question of how to determine authorship – and hence ownership - of copyright in collaborative works is an important question to which current copyright law fails to provide a coherent or consistent answer. In Copyright and Collective Authorship, Daniela Simone engages with the problem of how to determine the authorship of highly collaborative works. Employing insights from the ways in which collaborators understand and regulate issues of authorship, the book argues that a recalibration of copyright law is necessary, proposing an inclusive and contextual approach to joint authorship that is true to the legal concept of authorship but is also more aligned with creative reality.

EU Collective Labour Law

  • Categories: Law

This unique book offers a comprehensive systematization and overview of the EU´s emerging ‘acquis’ and practice of Collective Labour Law. Although the core aspects of Collective Labour Law lie outside the EU’s competence to regulate, the laws and industrial relations systems of Member States are undoubtedly influenced by the EU, and the involvement of Social Partners, i.e. representatives of employers and workers, is essential for many aspects of EU law and policy.
