Nessa obra encontram-se os resultados de pesquisas desenvolvidas em nível de pós-graduação (mestrado e doutorado) ao longo do 2o semestre de 2020 na Faculdade de Direito da USP. Estudaram-se setores em que há interfaces do direito público com o direito da proteção de dados pessoais, como se verifica no processo eleitoral, na segurança pública e na atividade do Fisco, assim como foram realizadas pesquisas sobre temas recorrentes, entre os quais os da administração pública, Poder Judiciário, advocacia, relações de trabalho e saúde. Além disso, a obra conta com estudos em temas menos explorados, como inovação tecnológica, criança, adolescente, idoso e pessoa com deficiência, a transferência internacional de dados e o estudo de direito comparado das autoridades nacionais de proteção de dados. Os capítulos presentam a descrição do setor, a relevância do tratamento de dados, a identificação dos agentes de tratamento e as dificuldades encontradas para o cumprimento da LGPD.
A primazia pela indenização não monetária do dano moral
A partir da constatação da ampliação dos danos extrapatrimoniais indenizáveis, em razão do giro conceitual do ato ilícito ao dano injusto, o autor analisa a seleção dos interesses dignos de tutela a fim de definir os interesses que caracterizam o dano moral e demonstrar que a indenização exclusivamente pecuniária, de solução igual e uniforme, é insuficiente a compensá-lo, pois não atende as peculiaridades do interesse lesado e da vítima. Assim, a presente obra visa determinar que o sistema indenizatório deve guiar-se por medidas de ressarcimento que melhor se aproximem da reparação integral do dano moral, razão pela qual opta-se pela posição prioritária da indenização in natura no ordenamento brasileiro, enquanto o meio monetário pela entrega em dinheiro seja subsidiário e complementar à compensação do dano moral. Para isso, o autor sugere a adequação processual, por meio de proposta de lege ferenda e critérios objetivos a nortear o Estado-juiz nas demandas de indenização por dano moral, a fim de conferir integração entre o direito material e processual civil na reparação adequada ao dano moral.

In 1790, Xavier de Maistre was 27 years old, and a soldier in the army of the Sardinian Kingdom, which covered swathes of modern-day Northern Italy and Southern France. He was placed under house-arrest in Turin for fighting an illegal duel. It was during the 42 days of his confinement here that he wrote the manuscript that would become Voyage autour de ma chambre. Inspired by the works of Laurence Sterne, with their digressive and colloquial style, de Maistre decided to make the most of his sentence by recording an exploration of the room as a travel journal. de Maistre’s book imbues the tour of his chamber with great mythology and grand scale. As he wanders the few steps that it takes to circumnavigate the space, his mind spins off into the ether. It parodies the travel journals of the eighteenth-century (such as A Voyage Around the World by Louis de Bougainville, 1771), and could be read today as an early take on the modern vogue for “psychogeography” — each tiny thing that he encounters sends de Maistre into rhapsodies, and mundane journeys become magnificent voyages.
