Over and Over and Over Again

  • Categories: Art

Over the last twenty years, reenactment has been appropriated by both contemporary artistic production and art-theoretical discourse, becoming a distinctive strategy to engage with history and memory. As a critical act of repetition, which is never neutral in reactualizing the past, it has established unconventional modes of historicization and narration. Collecting work by artists, scholars, curators, and museum administrators, the volume investigates reenactment's potential for a (re)activation of layered temporal experiences, and its value as an ongoing interpretative and political gesture performed in the present with an eye to the future. Its contributions discuss the mobilization of archives in the struggle for inclusiveness and cultural revisionism; the role of the body in the presentification and rehabilitation of past events and (impermanent) objects; the question of authenticity and originality in artistic practice, art history, as well as in museum collections and conservation practices.

Women, Gender, and Constitutionalism in Latin America

  • Categories: Law

This book discusses to what extent and how constitutional design and practice in Latin America have helped in combatting the subordination of women and LGBTQIA+ people. Covering 11 jurisdictions, the chapters identify the main elements of the constitutional gender order and survey jurisprudential and legislative developments in different areas, incorporating contextual analysis and references to history, political dynamics, social movements, feminist struggles, normative efficacy, and policy. In the context of a constitutionalism that has been celebrated as particularly innovative and socially engaged, the book assesses constitutional performance in the quest to supersede the separate gender...

Sustainable Finance and Financial Crime

Sustainable Finance and Financial Crime

Sustainable finance is a holistic approach to the sustainability development goals (SDG), so that the interdependence between environmental, social, and governance issues is unveiled. Sustainable finance takes into account the various challenges following from social change and sustainability, the evolution of capital markets, and the development of efficient risk management practices. Governance issues are an integral part of sustainable finance. However, academic literature has generally neglected to consider strategies to prevent and fight financial crimes as a crucial component of sustainable finance. The aim of this book is to focus on the interconnectedness between sustainable finance and preventing/fighting financial crime, not only as a crucial governance issue, but also as a deep challenge for social and even environmental issues. There is no really sustainable finance without developing strong and efficient means to fight financial crimes.

Proportionality and Transformation

  • Categories: Law

This is the first book on proportionality in Latin American constitutional law. Leading scholars in the region explore how proportionality analysis has become a key part of the constitutional law of a region where, almost paradoxically, constitutions with clear transformative intentions coexist with the highest indicators of social inequality in the world. In this book, scholars, practitioners and students will find a fascinating account of how proportionality has been a central concept in Latin America's constitutional struggles to curtail excessive uses of state power. The book illustrates how, more recently, proportionality has played an important role in national processes of constitutionalization and transitional justice, and how its current uses in the domain of social rights endow it with a distinctive meaning and role in regional constitutionalism. This pioneering book opens up the space for a much needed global conversation on how Latin America has decisively contributed to comparative constitutional law.
