Sejak terkodifikasinya kitab-kitab hadits, perkembangan ijtihad dalam hukum Islam tidak menggembirakan, untuk tidak mengatakan mengalami kemandegan. Bahkan, hingga saat ini, para ulama masih terbelenggu dengan referensi hadits yang tersekat-sekat, juga dengan hierarkinya. Bukan hanya itu, dalam melakukan ijtihad dan mengambil istinbath hukum, para ulama masih merujuk pada kitab karya ulama berabad lampau, tanpa melihat konteks saat ini yang berbeda tempat dan waktu. Akibatnya, dinamika sosial yang melaju pesat dengan berbagai persoalan kemasyarakatan yang terkadang membutuhkan "jawaban hukum menurut Islam", justru tidak menemukan solusi hukumnya dalam fatwa dan ijtihad ulama masa kini. Oleh karena itu, dibutuhkan bahasan yang mengaitkan antara kodifikasi hadits dan kreativitas berijtihad dalam kajian-kajian fiqh. Kodifisi hadits, khususnya al-kutub as-sittah, dianggap menghambat perkembangan ijtihad karena hierarkinya yang membelenggu. Lebih jauh, teks-teks nash yang sudah ada perlu dikembangkan dengan pamahaman-pemahaman dan perspektif baru sehingga menjadi energi yang luar biasa bagi dinamika ijtihad sekaligus kemampuan Islam untuk menjawab persoalan kekinian.
Norman Calder is still considered a luminary in the field of Islamic law. He was one among a handful of Western scholars who were beginning to engage with the subject.
