This investigation relates to two alleged failures by the Northern Ireland Office to comply with its approved equality scheme relating: (1) an alleged failure to conduct the screening exercise in accordance with the requirements of paragraph 3.2 of its approved equality scheme; (2) an alleged failure to consult on the screening decision in accordance with requirements of paragraph 3.2(d) and 4.3. The Equality Commission sets out a number of recommendations in the light of its' investigations: that the Northern Ireland Office must undertake an Equality Impact Assessment of the Anti-Social Behaviour Order policy and legislation to its potential impact on children and young people; set out its reasons for not undertaking a full Equality Impact Assessment at the initial screening stage; ensure that any reasons given can be tallied with the implications for equality of opportunity; disclose evidence of differential impacts; address representations of significant adverse impact following the consultation process
