Das Adhäsionsverfahren ermöglicht, dass zivilrechtliche Ansprüche im Strafverfahren beurteilt werden. Seine gesetzliche Regelung in Art. 122 ff. StPO ist allerdings sehr rudimentär und lückenhaft. Rechtsprechung und Lehre befassen sich bislang kaum mit der Lückenhaftigkeit des Verfahrens bzw. dem damit verbundenen Koordinationsdefizit des Straf- und Zivilverfahrensrechts. Die Arbeit zeigt auf, wie Gesetzeslücken im Adhäsionsverfahren gefüllt und gleichsam das Straf- und Zivilverfahrensrecht koordiniert werden können. Die Arbeit zeigt auf, welche Leitgedanken für die Lückenfüllung massgeblich sind. Es wird erläutert wie mit Kollisionen zwischen Straf- und Zivilverfahrensrecht umzugehen ist. Mithilfe der entwickelten Methode liefert die Arbeit sodann konkrete Lösungsvorschläge für spezifische Verfahrensfragen.
