This volume provides an overview of insolvency laws and related rules and procedures in the countries of East Asia. In this volume Mitchell examines case law, academic debate and the resurgence of interest in formalist contract interpretation in the US to explore the meaning of contextual interpretation, arguments for and against it and suggestions on how parties may influence the interpretation methods applied to their agreement. Identifying controversial issues, arguments and analyzing possible future developments, this book addresses a range of questions, including: How far should it be possible for courts, through the process of interpretation, to control the bargain made between parties? Are judges applying the principles of interpretation in the same way? What is the relevant context of an agreement? Should contracting parties be able to opt out of a particular interpretative approach by use of mechanisms such as entire agreement clauses? Short and concise, this is a useful reference tool for those interested in contract and tort law.
From the point of view of economic history, the ideal way to study any institution of commercial law would be to compare the information contained in legal codes and treatises with the material relating to its application in economic life as manifested by actual contracts, letters, and business records found in archives and other repositories. In the case of the early centuries of the Islamic period, available sources unfortunately preclude such a procedure. Theoretical legal texts exist in abundance, but any corresponding documentary material is for all practical purposes non-extant. In order to determine if the framework in which the trade and commerce of the early Islamic period was carri...

Source separation of waste and subsequent recycling processes are promising solutions on the road to a circular economy. They reduce waste disposal and the need for resource deployment, while also producing secondary raw materials; as such, they have a significant effect on climate protection. This book presents source separation technologies and related aspects that form the basis for efficient recycling and a modern approach to waste management. It examines legislational drivers and policy aspects of adequate waste collection schemes, as well as segregation technologies and the success factors for their implementation. Summarizing the outcomes of a Sino-German workshop, the focus of this volume is mainly on the current situation in China and Germany. However, the findings are applicable to a broad range of situations and regions around the world. In addition, the book demonstrates the relevance of source separation for climate protection and describes alternative separation technologies. Given the breadth and depth of its coverage, the volume will appeal to environmental scientists, engineers, economists, waste managers and policymakers alike.
The concept of a circular economy has been gaining increasing attention in recent years. Many of the sources of chemicals we have become reliant on are dwindling and the accumulation of waste products poses a serious environmental problem. By recovering resources from these waste materials, we can reduce our dependence on virgin feedstocks that may not be sustainable as well as reducing the quantity of material going to landfill sites. Incorporating different perspectives from a global authorship, this book aims to introduce systems thinking to the field of waste and resource management. The topics covered range from the use of biogeochemical processes in resource recovery to the application of engineered nanomaterials, with information relevant to both academia and industry. The broad range and cross-disciplinary nature of the topics in this book make it a valuable resource for those working in circular economy research, green chemistry and waste and resource management.
