Legal, Moral, and Metaphysical Truths

  • Categories: Law

Perhaps more than any other scholar, Michael Moore has argued that there are deep and necessary connections between metaphysics, morality, and law. Moore has developed every contour of a theory of criminal law, from philosophy of action to a theory of causation. Indeed, not only is he the central figure in retributive punishment but his moral realist position places him at the center of many jurisprudential debates. Comprised of essays by leading scholars, this volume discusses and challenges the work of Michael Moore from one or more of the areas where he has made a lasting contribution, namely, law, morality, metaphysics, psychiatry, and neuroscience. The volume begins with a riveting cont...

This multi-disciplinary, multi-jurisdictional collection offers the first ever full-scale analysis of legal fictions. Its focus is on fictions in legal practice, examining and evaluating their roles in a variety of different areas of practice (e.g. in Tort Law, Criminal Law and Intellectual Property Law) and in different times and places (e.g. in Roman Law, Rabbinic Law and the Common Law). The collection approaches the topic in part through the discussion of certain key classical statements by theorists including Jeremy Bentham, Alf Ross, Hans Vaihinger, Hans Kelsen and Lon Fuller. The collection opens with the first-ever translation into English of Kelsen’s review of Vaihinger’s As If....

Eugenio Bulygin is a distinguished representative of legal science and legal philosophy as they are known on the European continent - no accident, given the role of the civil law tradition in his home country, Argentina. Over the past half-century, Bulygin has engaged virtually all major legal philosophers in the English-speaking countries, including H.L.A. Hart, Ronald Dworkin, and Joseph Raz. Bulygin's essays, several written together with his eminent colleague and close friend Carlos E. Alchourrón, reflect the genre familiar from Alf Ross's On Law and Justice, Hans Kelsen's Pure Theory of Law, and Georg Henrik von Wright's Norm and Action. Bulygin's wide-ranging interests include most of...

The Defeat of Germany

In January 1944, the headquarters of the Supreme Commander Allied Expeditionary Force was set up in London. Although over 500 correspondents, photographers and broadcasters had been accredited by the Public Relations Division to cover the invasion of France, SHAEF also decided to issue its own daily communiqués, charting the progress of the battle and over the following months nearly 400 were released. Alongside the measured text of the official communiqués hundreds of photographs — many complete with censor deletions — taken by war photographers in France, Belgium, Holland, Luxembourg and Germany, are reproduced alongside ‘then and now’ comparison photos taken by After the Battle. Illustrating the battles by the western Allies to liberate western Europe, we follow the fighting day by day, beginning from D-Day in Normandy until the final defeat of Nazi Germany in Berlin.
