Leading scholars and legal practitioners explore constitutional, legal, and philosophical topics. In Constitutionalism, Executive Power, and the Spirit of Moderation, contributors ranging from scholars to practitioners in the federal executive and judicial branches blend philosophical and political modes of analysis to examine a variety of constitutional, legal, and philosophical topics. Part 1, “The Role of Courts in Constitutional Democracy,” analyzes the proper functions and limits of the judiciary and judicial decision making in constitutional government. Part 2, “Law and Executive Authority,” reflects on the tensions between constitutionalism and presidential leadership in both domestic and international arenas. Part 3, “Liberal Education, Constitutionalism, and Philosophic Moderation,” shifts the focus to the relationship between constitutionalism and political philosophy, and especially to the modern modes of philosophy that most directly influenced the American Founders. A valuable resource for specialists, the book also will be of use in political science and law school classes.

Understanding Contexts Of Business In Western Asia: Land Of Bazaars And High-tech Booms

Not one size fits all. Yet, some books teach business with minimal focus on the context for business. In reality, firms — large and small — are highly affected by the context in which they operate; yet, context is not uniformly conceptualized, theorized, and operationalized by scholars of business and management. While most theories have come from developed countries with bountiful contexts, the diverse contexts of Western Asia are little understood. Religious factors are profoundly dominant in Western Asia, and businesses in this diverse area operate with considerations that are rarely considered in research. This book reveals a variety of schools of thought that have molded several business models and mechanisms, which are, to some extent, different from the context of Western economies.

Against All Odds

As part of a wider democracy promotion effort, political parties in Georgia and Ukraine, as in most other post-communist states, have received assistance from a number of non-governmental but governmentfunded western organizations for most of the post-communist period. This assistance, however, has persistently failed to contribute to making parties in the two former Soviet republics substantially more stable, democratic, and representative. In searching for an answer to why the assistance has not been more effective, this thesis looks both at the nature of the assistance and the particularities of party politics in Georgia and Ukraine. The thesis argues that, as a consequence of domestic constraints on party development, political parties in Georgia and Ukraine were essentially unsuitable as recipients of party assistance and that, therefore, party assistance was poorly positioned to make an impact.

Beyond Classical Liberalism

This volume brings together diverse sets of standpoints on liberalism in an era of growing skepticism and distrust regarding liberal institutions. The essays in the volume: • Relate concerns for liberal institutions with classical themes in perfectionist politics, such as the priority of the common good in decision-making or the role of comprehensive doctrines. • Analyse how perfectionist intuitions about the political life affect our concepts of public reason or public justification. • Outline various moral duties we have toward other persons that underlie the liberal institutions or notions of rights functioning across the contemporary political landscape. • Explore various aspects of pluralism from within influential religious or philosophical traditions, applying insights from those traditions to issues in contemporary politics. The comprehensive volume will be of great interest to scholars, students, and researchers of politics, especially those in political philosophy and political theory.
