Translation and the Law

This long needed reference on the innumerable and increasing ways that the law intersects with translation and interpreting features essays by scholars and professions from the United States, Australia, Hong Kong, Iceland, Israel, Japan, and Sweden. The essays range from sophisticated treatments of historical and hence philosophical variations in concept and practice to detailed practical advice on self-education. Essays show a particular concern for the challenges of courtroom discourse when the parties not only use different languages but operate from different cultural and legal traditions.

Merger Control Regimes in Emerging Economies

  • Categories: Law

When emerging economies draft competition law and begin to enforce it, they usually draw on the EU and US competition law systems. However, significant country-specific legal and practical variations tend to arise quickly, making it imperative for international business lawyers to acquire more than a passing knowledge of competition legislation and relevant case law in these countries. Now for the first time a thoroughly researched book provides an in-depth empirical analysis of the legal problems raised for competition, and especially for merger control and its enforcement, in emerging economies, using a case study approach in the Brazilian and Argentinean contexts to reveal paradigmatic tr...

Translation is subject to a complex and unique set of legal rules that govern its various practical and intellectual aspects. These rules derive from very different legal areas, such as intellectual property and labour law. While useful from a strictly legal point of view, the heterogeneity of sources operates as a major hurdle in terms of understanding the overall legal framework within which translation operates. This book offers a general overview of the legal rules applicable to different aspects of translation, allowing translators and other interested parties to form a broad and coherent picture of the rules applicable in this area. It draws on the provisions of the main legal systems ...

Struggles over land and water have determined much of New Mexico’s long history. The outcome of such disputes, especially in colonial times, often depended on which party had a strong advocate to argue a case before a local tribunal or on appeal. This book is partly about the advocates who represented the parties to these disputes, but it is most of all about the Hispanos, Indians, and Genízaros (Hispanicized nomadic Indians) themselves and the land they lived on and fought for. Having written about Hispano land grants and Pueblo Indian grants separately, Malcolm Ebright now brings these narratives together for the first time, reconnecting them and resurrecting lost histories. He emphasizes the success that advocates for Indians, Genízaros, and Hispanos have had in achieving justice for marginalized people through the return of lost lands and by reestablishing the right to use those lands for traditional purposes.

Enforcing the Rule of Law

Reports of scandal and corruption have led to the downfall of numerous political leaders in Latin America in recent years. What conditions have developed that allow for the exposure of wrongdoing and the accountability of leaders? Enforcing the Rule of Law examines how elected officials in Latin American democracies have come under scrutiny from new forms of political control, and how these social accountability mechanisms have been successful in counteracting corruption and the limitations of established institutions. This volume reveals how legal claims, media interventions, civic organizations, citizen committees, electoral observation panels, and other watchdog groups have become effective tools for monitoring political authorities. Their actions have been instrumental in exposing government crime, bringing new issues to the public agenda, and influencing or even reversing policy decisions. Enforcing the Rule of Law presents compelling accounts of the emergence of civic action movements and their increasing political influence in Latin America, and sheds new light on the state of democracy in the region.
