The protection of intellectual property in the People's Republic of China has been of great importance at least since the opening of the market in 1978. Although the first efforts to protect the rights of individuals in the field of copyright were made as early as the Qing Dynasty, it took until the 1990s before a copyright law was finally implemented. While the law is already quite advanced in the books, effective enforcement of rights has faced and continues to face many hurdles. Due to that and also to take account of technological progress and further developments at the international level, China's copyright law has been undergoing a reform process since 2012 which resulted in the 2020 Amendment of the Chinese Copyright Law that takes effect on 1 June 2021. This work focuses on the legal historical development of copyright law in the People's Republic of China with the aim of understanding the current reform of the Copyright Law and the problems China has faced and is facing. The adaption of copyright law to the digital age is currently one of the EU’s main concerns regarding intellectual property. This thesis analyses whether European legislation in this field can be successfully implemented in the same way in countries with different levels of development. Taking the examples of Germany and Armenia will help to evaluate the problems of developed and transition countries concerning the challenges of copyright in the digital age. The comparison between these two countries shows that a one-size-fits-all-approach is not appropriate in the digital environment. The socio-economic situation and the legal environment of transition countries call for a different solution. In this respect the example of Armenia may be instructive for other transition countries as well, especially CIS countries. A recommendation for adopting a certain system for drafting European legislation in the future which will meet the needs of all countries, considering their social, economic and legal situation, has been developed in this thesis.

Im deutschen Zivilprozessrecht hat nach wie vor jede Partei das Tatsachenmaterial zu beschaffen, das zu einer für sie günstigen Entscheidung führt. Die nicht oder nicht vollständig informierte Partei kann diese Aufgabe gegebenenfalls nicht erfüllen und verliert in der Folge den Prozess. Eine wesentliche Ursache dieses Informationsproblems liegt darin, dass der Gegner in gewissem Umfang selbst steuern kann, welche Informationen die risikobelastete Partei benötigt, und zwar indem er wahrheitswidrig bestreitet. Wirksame Mechanismen gegen diesen Wahrheitsverstoß existieren bislang nicht. Bei dem Versuch, die größten Härten des Informationsproblems abzumildern, hat sich im Lauf der Zeit eine unübersichtliche und teils in sich widersprüchliche Gemengelage von Regeln und Ausnahmen etabliert. Dem setzt die Untersuchung einen Entwurf für ein prozessrechtliches Aufklärungsmodell entgegen, das bei der Wahrheitspflicht der Parteien ansetzt und dem Gegner die Steuerungsmöglichkeit über das Informationsproblem der risikobelasteten Partei entzieht.
