As many disciplines in the humanities have experienced a focus on culture’s impact in recent decades, questions surrounding the significance of media such as writing, print and computer networks have become increasingly relevant. This book seeks to demonstrate that a media and cultural theory perspective can also be highly productive for legal theory.
Proposing a new interpretation of literature and mass culture in nineteenth-century Europe, this work focuses on works by Marx, Balzac, Dickens, Adorno, and Benjamin to explore in them a complex "mimetic" disposition toward commodification in the realm of culture. The aim of the book is twofold: to explicate in the work of Balzac and Dickens subtle and profoundly ambivalent attitudes toward the rapidly expanding mass culture of the 1830's in France and England, and to identify through this reading of the novelists a common mimetic element that has eluded a certain dialectical approach to art's overcoming of mass culture - an approach best exemplified in Horkheimer and Adorno's influential essay on the "culture industry."

German studies has confronted many crises, as well as severe criticism and self-criticism, and yet it has managed to maintain its disciplinary system through every upheaval--the revolution of 1848, the establishment of the Second Reich in 1871, the Weimar Republic, the Nazi Third Reich, the Second World War and the reconstruction era, the creation and reunification of the two German states. Pier Carlo Bontempelli focuses on this continuity, dating back to the early nineteenth century, when the "founding fathers" of Germanistik secured its status by grounding it in a set of fixed principles, revived by each successive generation of scholars in order to legitimize their position of power--and to ensure their capacity for cultural reproduction. Using the works of Michel Foucault and Pierre Bourdieu, Bontempelli investigates the institution and principles of German studies and critically reconstructs its history. Mindful of the mechanisms of choice and domination operating at every turn in this history, his book exposes the repressed social and political history of German studies.

German Idealism develops its philosophy of history as the theory of becoming absolute and as absolute knowledge. Historism also originates from Hegel's and Schelling's discovery of absolute historicity as it turns against Idealism's philosophy of history by emphasizing the singular and unique in the process of history. German Idealism and Historism can be considered as the central German contribution to the history of ideas. Since Idealism became most influential for modern philosophy and Historism for modern historiography, they are analyzed in this volume in a collaboration of philosophers and historians.
