A gestação de substituição coloca desafios a conceitos, institutos ou figuras jurídicas tradicionais, quer do Direito Contratual, quer do Direito da Família e dos Direitos Fundamentais de todas as partes envolvidas. Adicionalmente, os perigos, riscos e consequências da prática da gestação de substituição transfronteiriça têm despertado cada vez mais o interesse e a preocupação de instituições e organizações europeias e internacionais, debatendo-se a necessidade e urgência dos Estados legislarem (interna e internacionalmente) sobre o tema e, sobretudo, de garantirem os direitos da criança nascida na sequência de um contrato de gestação de substituição. Neste contexto, propomos o estudo das problemáticas e desafios da gestação de substituição, desde os seus conceitos basilares aos argumentos favoráveis ou obstativos à sua prática, incluindo o regime jurídico na ordem jurídica portuguesa e a gestação de substituição transfronteiriça.
