Eficácia do protocolo familiar no direito brasileiro
As empresas familiares representam importante contribuição para a economia mundial. A despeito de elementos que conferem grande diferencial competitivo a essas corporações, existem grandes debilidades próprias de momentos inevitáveis em sua existência prolongada ao tempo. A presente pesquisa parte do exame teórico conceitual da empresa familiar, seus diferenciais competitivos, suas debilidades e os instrumentos que vêm sendo utilizados para minorá-las. Após cotejar os instrumentos mais utilizados com a legislação do velho continente e da América Latina, para auferir o nível de limitação imposto pelas regras do direito de família, especialmente na eficácia do chamado protocolo familiar, serão examinados casos concretos e práticas que tiveram êxito na manutenção do diferencial competitivo próprio das empresas familiares, minorando debilidades causadas, especialmente, por ocasião da sucessão entre gerações.
