Die Richtlinie 2005/29/EG über unlautere Geschäftspraktiken stellt den bislang umfassendsten Schritt zur Harmonisierung und Angleichung des Wettbewerbsrechts in Europa dar. Der Anwendungsbereich der Richtlinie ist anders als bei vorhergehenden Richtlinien auf den Geschäftsverkehr zwischen Gewerbetreibenden und Verbrauchern begrenzt. Sowohl in Spanien als auch in Deutschland führte die Umsetzung der Richtlinie zu zahlreichen Neuerungen, in Spanien sogar zu einer kompletten Überarbeitung des Wettbewerbsgesetzes. Im Rahmen dieser Arbeit wird nun die Umsetzung der Richtlinie über unlautere Geschäftspraktiken in Spanien und in Deutschland vergleichend betrachtet.
La actual teoría de la prueba en el mundo latino se caracteriza por la aceptación generalizada de que el proceso judicial se orienta a la búsqueda de la verdad y por la necesidad de una justificación racional del juicio de hecho, es decir, por un enfoque argumentativo de la prueba. Esta investigación estudia el origen y desarrollo de esta concepción, a través de la descripción y análisis del trabajo de los siete autores que podrían ser considerados como sus artífices pioneros: Lluís Muñoz Sabaté, Michele Taruffo, Perfecto Andrés Ibáñez, Juan Igartua Salaverría, Marina Gascón Abellán, Jordi Ferrer Beltrán y Daniel González Lagier. Finalmente se aportan algunas ideas sobre el trabajo que aún está por hacerse para un pleno desarrollo de la teoría de la prueba en el mundo latino.
