Intellectual Property and Human Development

  • Categories: Law

This book examines the social impact of intellectual property laws. It addresses issues and trends relating to health, food security, education, new technologies, preservation of bio-cultural heritage and contemporary challenges in promoting the arts. It explores how intellectual property frameworks could be better calibrated to meet socio-economic needs in countries at different stages of development, with local contexts and culture in mind. A resource for policy-makers, stakeholders, non-profits and students, this volume furthermore highlights alternative modes of innovation that are emerging to address such diverse challenges as neglected or resurgent diseases in developing countries and the harnessing of creative possibilities on the Internet. The collected essays emphasize not only fair access by individuals and communities to intellectual property – protected material, whether a cure, a crop variety, clean technology, a textbook or a tune – but also the enhancement of their own capabilities in cultural participation and innovation.

This volume brings together Indigenous and non-Indigenous repatriation practitioners and researchers to provide the reader with an international overview of the removal and return of Ancestral Remains. The Ancestral Remains of Indigenous peoples are today housed in museums and other collecting institutions globally. They were taken from anywhere the deceased can be found, and their removal occurred within a context of deep power imbalance within a colonial project that had a lasting effect on Indigenous peoples worldwide. Through the efforts of First Nations campaigners, many have returned home. However, a large number are still retained. In many countries, the repatriation issue has driven ...

EdenWorld has beer-colored seas, amber skies, and is inhabited by griffins, minotaurs, vampires, werewolves and other fantastic creatures who have enslaved the human population. Commander Bill Keeler and his landing party visit this strange world and start off along a highway paved in golden stones to meet the powerful ruler of a mythical kingdom. Along the way, they encounter a mentally deficient crop guardian, a malfunctioning robot with a failing power cell, and an anthropomorphic lion with cowardice issues. Also, there's a B-Story involving the kidnapping of Goneril Lear's son; a C-Story involving Phil Redfire falling for a hot woman on a cold night; a D-Story where another character schemes to get relieved from his duties; and an E-Story involving exiles on the planet's surface with an amazing knack for adapting the ship's advanced technology.

Repatriation, Science and Identity

Repatriation, Science, and Identity explores the entanglement of race, history, identity and ethics inherent in the application of scientific techniques to determine the provenance of Indigenous Ancestral Remains in repatriation claims and processes. The book considers how these issues relate to collections of Indigenous Ancestral (bodily) Remains but also their resonance with emerging concerns about the relatively unknown history of scientific interest in Indigenous hair and blood samples. It also explores the more recent practice of sampling for the purposes of DNA analysis and issues concerning the data that has been produced from all of the above types of research. Placing recent interes...

These Were People Once

People buy and sell human remains online. Most of this trade these days is over social media. In a study of this ‘bone trade’, how it works, and why it matters, the authors review and use a variety of methods drawn from the digital humanities to analyze the sheer volume of social media posts in search of answers to questions regarding this online bone trade. The answers speak to how the 21st century understands and constructs ‘heritage’ more generally: each person their own expert, yet seeking community and validation, and like the major encyclopedic museums, built on a kind of digital neocolonialist othering of the dead.

Cultural Objects and Reparative Justice

  • Categories: Law

Cultural Objects and Reparative Justice provides a comprehensive legal and historical analysis surrounding a highly debated current question: Where should cultural objects that were removed without consent be located? This book follows an innovative, interdisciplinary approach based in law, history, art history, anthropology, and archaeology and proposes a paradigm for reparations. Tracing the historical foundations of the current legal framework, the work closely examines three factors that heavily informed the cultural heritage debate since the late eighteenth century: the rise of the encyclopaedic museum, the development of archaeology as a science, and the appropriation of objects in the...

This book provides a comprehensive examination of death, dying, and human remains in museums and heritage sites around the world. Presenting a diverse range of contributions from scholars, practitioners, and artists, the book reminds us that death and the dead body are omnipresent in museum and heritage spaces. Chapters appraise collection practices and their historical context, present global perspectives and potential resolutions, and suggest how death and dying should be presented to the public. Acknowledging that professionals in the galleries, libraries, archives, and museums (GLAM) fields are engaging in vital discussions about repatriation and anti-colonialist narratives, the book inc...

A Companion to Contemporary Art in a Global Framework

  • Categories: Art

WILEY BLACK WELL COMPANIONS TO ART HISTORY A Companion to Contemporary Art in a Global Framework A Companion to Contemporary Art in a Global Framework explores the ways specialists and institutions in the fine arts, curation, cultural studies, and art history have attempted to situate art in a more global framework since the 1980s. Offering analyses of the successes and setbacks of these efforts to globalize the art world, this innovative volume presents a new and exciting way of considering art in its global contexts. Essays by an international panel of leading scholars and practicing artists assert that what we talk about as ‘art’ is essentially a Western concept, thus any attempts at ...

Material Encounters

This topical and conceptually innovative book proposes new perspectives on the theme of materiality which, since the 1980s, has animated work across and within disciplines in the Humanities and Social Sciences. The particular focus of the chapters in this volume is the materiality of knowledge produced through embodied encounters between people, places, and things in the Pacific Islands, New Guinea, Australia, and Myanmar. The authors consider how materiality mediates the ways in which knowledge is generated or acquired in encounters and becomes expressed through things and material forms of inscription – charts and maps; journals, letters, and reports; drawings; objects; human remains; le...
