Secara etimologis, istilah politik hukum adalah kata terjemahan dari bahasa Belanda rechtpolitiek yang berasal dari dua kata, recht dan politiek. Recht berarti hukum. Kata politiek dalam kamus bahasa Belanda memiliki pengertian beleid. Kata beleid dalam bahasa Indonesia memiliki arti kebijakan (policy). Dengan demikian politik hukum bisa diartikan kebijakan hukum. Adapun kebijakan sendiri dalam bahasa Indonesia berarti rangkaian konsep dan asas yang menjadi garis besar dan dasar rencana dalam pelaksanaan suatu pekerjaan, kepemimpinan dan cara bertindak. Dalam hal ini politik hukum dapat diartikan rangkaian konsep dan asas yang menjadi garis besar dan dasar rencana dalam pelaksanaan suatu pekerjaan, kepemimpinan dan cara bertindak dalam bidang hukum.
Maraknya kasus pembunuhan di Indonesia saat ini patut diduga karena hukuman tidak setimpal dengan kejahatan dan kurang tegas. Adanya pemikiran Implementasi Konsep Hukuman Qishash di Indonesia dapat menjadi solusi untuk mengurangi kasus tersebut. Hukuman Qishash hanya berlaku pada pembunuhan disengaja dan segala jenis pembunuhan dapat diganti dengan diyat bila dimaafkan oleh keluarga korban. Qishash dapat dijadikan sumber karena adanya kesamaan asas hukum pidana Islam dan KUHP, fleksibilitas hukum dan pluralitas hukum, pengujian undang-undang, dan kuantitas umat Islam di Indonesia. Kurang kuatnya political will di kalangan elit Islam, kekhawatiran terhadap disintegritas bangsa, berbagai kendala baik institusional dan internal, efektivitas hukuman mati di Indonesia, adanya penentang hukuman mati, asumsi pelanggaran HAM, dan potensi tekanan orang kaya terhadap miskin menjadi faktor penghambat bagi penerapan hukuman Qishash. Buku ini sangat bermanfaat bagi kalangan akademisi dan sebagai masukan bagi perancangan/perumusan penyempurnaan KUHP di Indonesia dan masyarakat umum pencari keadilan.

This book examines Islam and women’s everyday life, focusing in particular on the highly controversial issue of polygamy. It discusses the competing interpretations of the Qur’anic verses that are at the heart of Muslim controversies over polygamy, with some groups believing that Islam enshrines polygamy as a male right, others seeing it as permitted but discouraged in favour of monogamy, and other groups arguing that Islam implicitly prohibits polygamy.
