Yearbook Maritime Law

  • Categories: Law

I. The importance of legal questions related to the sea is obvious to everyone. It is hardly surprising that the subjects that make up international current events illustrate the leading role played by maritime affairs. Indeed, it is no coincidence that three quarters of the earth's surface is covered by oceans. Territorial seas, exclusive economic zones, exploitation of the seabed, fishing, transport, insurance, collision, and pollution raise many unresolved questions. On the other hand, the contrast of this importance with the modest attention that existing periodical publications merit must be underscored. Without undervaluing these publications, there has been a need for some time to create a vehicle of common expression, based on three central tenets: interdisciplinary framework, tendency towards uniform law, and both a theoretical and practical approach. a. A framework of interdisciplinary nature seems to be relevant as it is desirable to overcome the artificial separation between public and private law.

An Anarchy of Families

Winner of the Philippine National Book Award, this pioneering volume reveals how the power of the country's family-based oligarchy both derives from and contributes to a weak Philippine state. From provincial warlords to modern managers, prominent Filipino leaders have fused family, politics, and business to compromise public institutions and amass private wealth--a historic pattern that persists to the present day. Edited by Alfred W. McCoy, An Anarchy of Families explores the pervasive influence of the modern dynasties that have led the Philippines during the past century. Exemplified by the Osmeñas and Lopezes, elite Filipino families have formed a powerful oligarchy--controlling capital...

EU Citizens’ Economic Rights in Action

  • Categories: Law

Ever since its inception, one of the essential tasks of the EU has been to establish the internal market. Despite the impressive body of case law and legislation regarding the internal market, legal and factual barriers still exist for citizens seeking to exercise their full rights under EU law. This book analyses these barriers and proposes ways in which they may be overcome. Next to analysing the key barriers to exercising economic rights more generally, this book focuses on three areas which represent the applications of the four basic freedoms: consumer rights, the rights of professionals in gaining access to the market, and intellectual property rights in the Digital Single Market. With...

Long Crisis

What's in a presidency? In this book, Ken Fuller methodically dissects the headline-grabbing events surrounding the nine-year administration of Gloria Macapagal-Arroyo, discussing the circumstances that led to her rise to power and allowed her to maintain hold of it despite numerous controversies. Analyzing Arroyo's laundry list of alleged wrongdoings in the context of neocolonization and Philippine socioeconomic and political history, he asserts that her presidency "e;must be seen (at least in part) as a product rather than the cause of the fundamental problems confronting the Philippines"e;-problems that, though Arroyo is no longer president, continue to plague the country.

International maritime law is far from inert, everyday international affairs constantly test existing law and, in many occasions, require its development. Serving the Rule of International Maritime Law is thus not limited to a description of the current state of the law, but contains innovative studies on current issues and events that are testing the present state of international maritime law. The book is intended as a Liber Amicorum to Professor David Joseph Attard. It celebrates his career in international law; he played a crucial role in establishing the IMO International Maritime Law Institute in 1988, the main purpose of which is to train lawyers in private and public international ma...
