The Role of the Court of Justice in EU Labour Law

  • Categories: Law

In an unresolved ongoing debate, the Court of Justice of the European Union (CJEU) is often included among the institutional actors responsible for the declining condition of labour law in Europe. Has its case law been more protective of employers’ interests than of workers’ rights? This innovative book greatly enhances the discussion by bringing to light the judicial lawmaking logic, other than those pertaining to the balancing of social and business values, that drive the CJEU’s reasoning in its interpretation of the labour law provisions enshrined in the European Union (EU) law, with particular attention to the directive on transfer of undertakings. Addressing fundamental issues –...

Geometric Continuum Mechanics and Induced Beam Theories

This research monograph discusses novel approaches to geometric continuum mechanics and introduces beams as constraint continuous bodies. In the coordinate free and metric independent geometric formulation of continuum mechanics as well as for beam theories, the principle of virtual work serves as the fundamental principle of mechanics. Based on the perception of analytical mechanics that forces of a mechanical system are defined as dual quantities to the kinematical description, the virtual work approach is a systematic way to treat arbitrary mechanical systems. Whereas this methodology is very convenient to formulate induced beam theories, it is essential in geometric continuum mechanics when the assumptions on the physical space are relaxed and the space is modeled as a smooth manifold. The book addresses researcher and graduate students in engineering and mathematics interested in recent developments of a geometric formulation of continuum mechanics and a hierarchical development of induced beam theories.

The History of Theoretical, Material and Computational Mechanics - Mathematics Meets Mechanics and Engineering

This collection of 23 articles is the output of lectures in special sessions on “The History of Theoretical, Material and Computational Mechanics” within the yearly conferences of the GAMM in the years 2010 in Karlsruhe, Germany, 2011 in Graz, Austria, and in 2012 in Darmstadt, Germany; GAMM is the “Association for Applied Mathematics and Mechanics”, founded in 1922 by Ludwig Prandtl and Richard von Mises. The contributions in this volume discuss different aspects of mechanics. They are related to solid and fluid mechanics in general and to specific problems in these areas including the development of numerical solution techniques. In the first part the origins and developments of co...

Numerical Techniques for Engineering Analysis and Design

Numerical methods and related computer based algorithms form the logical solution for. many complex problems encountered in science and engineering. Although numerical techniques are now well established, they have continued to expand and diversify, particularly in the fields of engineering analysis and design. Various engineering departments in the University College of Swansea, in particular, Civil, Chemical, Electrical and Computer Science, have groups working in these areas. It is from this mutual interest that the NUMETA conference series was conceived with the main objective of providing a link between engineers developing new numerical techniques and those applying them in practice. E...

Service Contracts

  • Categories: Law

The rules presented in this volume of "Principles of European Law" deal with service contracts. The economic importance of service contracts within the European Union is enormous. The European Commission recently estimated that services account for some 50% of EU GDP and for some 60% of employment in the Union – though an exact figure is hard to determine given that many services are provided by manufacturers of goods. According to the European Commission, many services appear in official statistics as manufacturing activity, meaning that the role of services in the economy is often significantly underestimated.

Mastering modelling, and in particular numerical models, is becoming a crucial and central question in modern computational mechanics. Various tools, able to quantify the quality of a model with regard to another one taken as the reference, have been derived. Applied to computational strategies, these tools lead to new computational methods which are called "adaptive". The present book is concerned with outlining the state of the art and the latest advances in both these important areas.Papers are selected from a Workshop (Cachan 17-19 September 1997) which is the third of a series devoted to Error Estimators and Adaptivity in Computational Mechanics. The Cachan Workshop dealt with latest advances in adaptive computational methods in mechanics and their impacts on solving engineering problems. It was centered too on providing answers to simple questions such as: what is being used or can be used at present to solve engineering problems? What should be the state of art in the year 2000? What are the new questions involving error estimators and their applications?

European Yearbook 1996

The "European Yearbook" promotes the scientific study of nineteen European supranational organisations, including the Organisation for Economic Co-operation and Development (OECD). Each volume contains a detailed survey of the history, structure and yearly activities of each organisation and an up-to-date chart providing a clear overview of the member states of each organisation. In addition, a number of articles on topics of general interest are included in each volume. A general index by subject and name, and a cumulative index of all the articles which have appeared in the "Yearbook," are included in every volume and provide direct access to the "Yearbook"'s subject matter. Each volume contains a comprehensive bibliography covering the year's relevant publications. This is an indispensable work of reference for anyone dealing with the European institutions.

Proceedings of the 2022 Eurasian OpenSees Days

This book highlights the latest advances, innovations, and applications in the field of structural and geotechnical engineering, as presented by leading international researchers and engineers at the 2nd Eurasian Conference on OpenSees—Open System for Earthquake Engineering Simulation (EOS), held in Turin, Italy, on July 7–8, 2022. The conference was meant to give an overview on the latest developments made with the OpenSees framework as well as to present research and practical outcomes in which OpenSees plays an important role. Conference topics cover cutting-edge applications of OpenSees in the field of structural and geotechnical engineering, the development of new elements and materials, and also the development of new pre- and post-processors. The contributions, which were selected by means of a rigorous international peer-review process, present a wealth of exciting ideas that will open novel research directions and foster multidisciplinary collaboration among different specialists.
