International Labour Law

  • Categories: Law

No one will deny that labour standards comprise a necessary framework for balanced economic and social development. Yet on a global level such balanced development has not occurred, despite the existence of a rigorous body of international labour law that has been active and growing for almost one hundred years. The implementation of this law devolves upon states; yet many states have failed to honour it. If we are to take serious steps toward a remedy for this situation, there is no better place to start than a thorough, well-researched survey and analysis of existing international labour law - its sources, its content, its historical development, and an informed consideration of the barrie...

Class and Social Background Discrimination in the Modern Workplace

This book exposes how inequalities based on class and social background arise from employment practices in the digital age. It considers instances where social media is used in recruitment to infiltrate private lives and hide job advertisements based on locality; where algorithms assess socio-economic data to filter candidates; where human interviewers are replaced by artificial intelligence with design that disadvantages users of classed language; and where already vulnerable groups become victims of digitalisation and remote work. The author examines whether these practices create risks of discrimination based on certain protected attributes, including ‘social origin’ in international labour law and laws in Australia and South Africa, ‘social condition’ and ‘family status’ in laws within Canada, and others. The book proposes essential law reform and improvements to workplace policy.

Transnational Crime and Human Rights offers an evaluation of the responses to the transnational crime of human trafficking and governance of the issue through a case study of the Greater Mekong Subregion (GMS), which comprises Cambodia, the People's Republic of China, Lao People's Democratic Republic, Myanmar, Thailand, and Viet Nam. The book analyses the international and national legal policy frameworks and the role of governments, international and national non-governmental institutions, and regional processes in responding to trafficking issues in the GMS. The book is based on the findings of a three year study conducted in the region, involving interviews with more than 60 individuals from relevant organizations and agencies, and examines the social, political and historical factors, including gender and age, labour exploitation and migration which form the background to human trafficking in the GMS. The authors consider issues of competing mandates, and gaps in strategies for protection and conclude with a discussion of broader lessons to be learned from the GMS situation and suggestions for future governance strategies in the fight against trafficking.

The International Labour Organization

This book is the first comprehensive account of the International Labour Organization’s 100-year history. At its heart is the concept of global social policy, which encompasses not only social policy in its national and international dimensions, but also development policy, world trade, international migration and human rights. The book focuses on the ILO’s roles as a key player in debates on poverty, social justice, wealth distribution and social mobility subjects and as a global forum for addressing these issues. The study puts in perspective the manifold ways in which the ILO has helped structure these debates and has made – through its standard-setting, technical cooperation and myriad other activities – practical contributions to the world of work and to global social policy.

Fundamental Rights

Fundamental Rights

In Europe, fundamental rights have come to be regulated by an increasing number of legal instruments, such as the European Convention on Human Rights (ECHR), the EU Charter of Fundamental Rights, and international treaties. It is not always easy to understand what requirements are set in these different instruments and how they interrelate. This textbook therefore provides an integrated and systematic overview of the requirements imposed by international and European fundamental rights law. It discusses a range of both civil/political fundamental rights (eg freedom of expression) and social/economic rights (eg right to health), for each of which it is discussed how it is protected by the ECHR, by other Council of Europe instruments, by EU law, and by international treaty instruments. Each chapter is concluded with an integration section, which explains the relations between the different systems of fundamental rights protection and discuss differences, overlap and bottlenecks.

Hegel, Marx and the Contemporary World

This book is the result of a three-day conference held in April 2014 at the University of Montreal, Canada, discussing the relevance of the work of Hegel and Marx in today’s world, particularly with regard to the ecological, economic, political and anthropological crisis facing humanity. Accordingly, the book an exploration of the specific nature of the crisis we face both in our everyday lives and in the realm of theory. However, if indeed the necessity of a proper critique (Kritikos) is intimately linked to a state of crisis (Krisis), the conceptual frame necessary to produce such a critique may itself be in crisis. Among the vast number of critical oppositions to contemporary capitalism...
