"This course by Jochen Frowein, directeur of the Max Planck Institute for Comparative Public Law and International Law in Heidelberg, is devoted to an issue that has become increasingly prominent in the past decades. Until about 1970 it was agreed that international law, as far as violations and counter-measures were concerned, operated in a bilateral relationship between a State that violated international law and a victim-State. Around 1970, things changed. This course is concerned with the study of the possibilities for States that are not directly the victims of a violation of international law to take some reaction against it. In the first chapter, Professor Frowein gives an outline of the constitutionalization of the international community. He then studies the third State reactions under the United Nations Charter. In what follows he examines the possible reactions within the framework of different treaty systems. Professor Frowein also analyses the reactions to violations of obligations erga omnes. In the last chapter, the author shows that there exists a need for third-party States' reactions"--Publisher's description.

Now in its sixth year, the "Max Planck Yearbook of United Nations Law" has become a forum for essays in international law related to the UN. These essays again cover a variety of topics - from opening the International Court of Justice to the Security Council's authorization of enforcement action by Regional Organisations, from financial mechanisms in Environmental Agreements to questions of impunity under international human rights law and the prosecution of human rights offenders. Other subjects covered include, for example, the UNESCO Convention on Underwater Cultural Heritage, ITLOS and its first six years, and the International Criminal Court. The status of the Taliban under International Law and contemporary questions of submarine warfare are also subject of analysis.

This book deals with the transformation of the international legal system into a new world order. Looking at concepts and principles, processes and emerging problems, it examines the impact of global forces on international law. In so doing, it identifies a unified set of legal rules and processes from the great variety of state practice and jurisprudence. The work develops a new framework to examine the key elements of the global legal system, termed the 'four pillars of global law': verticalization, legality, integration and collective guarantees. The study provides an in-depth analysis of the differences between traditional international law and the new principles and processes along which the universal society and world power are organized and how this is related to domestic power. The book addresses important changes in key legal issues; it reconstructs a complex legal framework, and the emergence of a new international order that has still not been studied in depth, providing a compass that will prove a useful resource for students, researchers and policy makers within the field of law and with an interest in international relations.
