María José Falcón y Tella invites us on a fascinating journey through the world of law and literature, travelling through the different eras and exploring eternal and as such current issues such as justice, power, resistance, vengeance, rights, and duties. This is an unending conversation, which brings us back to Sophocles and Dickens, Cervantes and Kafka, Dostoyevsky and Melville, among many others. There are many ways to approach the concept of “Law and Literature”. In the classical manner, the author distinguishes three paths: the Law of Literature, involving a technical approach to the literary theme; Law as Literature, a hermeneutical and rhetorical approach to examining legal texts; and finally, Law in Literature, which is undoubtedly the most fertile and documented perspective (the fundamental part of the work focusses on this direction). This timely volume offers an introduction to this enormous field of study, which was born in the United States over a century ago and is currently taking root in the European continent.
Case law is a widely studied field, posing a series of questions. The first issue relates to the nature of case law itself, as the term cannot be given a single meaning. There is no one definition of case law, but rather a plurality of meanings depending on the historical period and legal system in question. After an analysis of Roman iurisprudentia and Anglo-Saxon case law, this work considers the Spanish legal system, as an example of a Continental jurisdiction, and distinguishes between the case laws of the Supreme and Constitutional Courts, the European courts, and the Superior Courts of Justice of the Autonomous Communities. The book analyses these issues, among many others, in a clear and in-depth manner, from an historical and comparative approach of great interest and academic value.
Arbitration in Spain is designed for two audiences: students of arbitration and practitioners. To some extent the two have different needs, and this book tries to satisfy the requirements of both audiences. For example, many of the contributions provide insight into the parliamentary discussions and proposals which took place at the time when the law was being debated in Congress, and thus offers an historical perspective for the student or arbitration. For the practitioner the book provides a step-by-step approach to the intricate world of Spanish arbitration.

Recht lebt in und von der Sprache. Daher ist der juristische Diskurs elementar für die Entwicklung rechtlicher Ordnung, auch der Europarechtsordnung. Jan Kalbheim analysiert zunächst die Diskurssituation des Europäischen Gerichtshofs als eines gewichtigen Diskursteilnehmers innerhalb der offenen Gesellschaft der Europarechtsinterpreten sowohl in personeller, als auch in institutioneller Hinsicht. Sodann untersucht er, ausgehend vom Kampf um die Änderung der EuGH-Rechtsprechung, diesen Diskurs in sechs exemplarischen Fallstudien. Damit erschließt er einen neuen Zugang zum Verständnis der Rechtsprechung des Europäischen Gerichtshofs und verdeutlicht die Aufgabe der anderen Diskursteilnehmer, insbesondere der nationalen Höchstgerichte und der Rechtswissenschaft, den europäischen juristischen Diskurs durch konstruktive Kritik dieser Rechtsprechung offen zu halten.

This work offers a Spanish perspective on contemporary practice in international law and European Community law by genuine practitioners such as registrars, judges and magistrates serving on national and international courts, as well as advocates practicing in these courts, senior international officials, government advisers and academics. In five parts this book deals with the practice in international courts; practice in international organizations; the European Community practice and; Spanish practice in matters of public and private international law. The last part contains an article on evidence in international practice and a general overview for further research. The book offers a very useful insight in matters otherwise available in Spanish, such as the applications against Spain lodged with the European Court of Human Rights, a comparison between the Spanish Constitutional Court and the Court of Justice of the European Communities, public international law before Spanish domestic courts and the Spanish practice on investment treaties.
