O Direito Regional e a Autonomia Tributária das Regiões Autónomas
Foram os frutos da fé e firmeza que fizeram vigorar do vale à montanha o atual regime político administrativo das regiões autónomas. Mas o que separa este regime próprio de uma verdadeira independência jurídica? A resposta a esta questão exigiu-nos uma desconstrução do próprio conceito de Direito, onde, com auxílio da dogmática jurídica, identificámos os pressupostos daquilo a que chamámos o “subsistema regional”. O Direito regional é nada mais que um subsistema e será dentro dele que encontraremos o conjunto de normas que irão compor a autonomia tributária das regiões autónomas. O que é um imposto regional? Podem as regiões autónomas criar benefícios fiscais? Quais os limites aplicáveis à redução de taxas de impostos? Serão a estas e outras questões que dedicaremos este trabalho.
