¿Derecho ordinario de excepción, estado de alarma o estado de excepción? Uno de los aspectos que la crisis sanitaria generada por la pandemia de la COVID-19 puso de manifiesto es el debate sobre el reparto de competencias entre las distintas administraciones públicas. Y es que la gestión legítima de una crisis sanitaria requiere, ante el estado actual del ordenamiento jurídico español, o bien centralizar toda la gestión sanitaria a través del Derecho de excepcionalidad o bien descentralizarla a través del Derecho ordinario de excepcionalidad. El presente trabajo ofrece un análisis pormenorizado de los distintos mecanismos de control del poder durante las crisis sanitarias, incorporando la jurisprudencia del Tribunal Constitucional —y en particular la STC 148/2021, de 14 de julio—, que modificó de manera radical los supuestos del estado de alarma; permitiendo que, siempre que sea necesario declarar un confinamiento domiciliario, al que ha catalogado como una suspensión de derechos, se adopte el estado de excepción.
