A Lei 8.072/90 foi elaborada com o objetivo de reprimir a prática de certos crimes, por meio da imposição de penas mais elevadas e restrição de alguns direitos fundamentais dos apenados bem como com o objetivo de transmitir a sensação de tranquilidade à sociedade, por meio da prevenção geral negativa. A maior problemática que circunda o tema é estabelecer o conceito de crime hediondo e os critérios que devem ser empregados para a eleição dos bens jurídico-penais que merecem a tutela mais severa do Estado, já que a forma como a Lei 8.072/90 apresenta tolhe os princípios da proporcionalidade e da razoabilidade, pois esvazia-se de conteúdo constitucional e afasta-se da ponderação, atendendo muitas vezes a voz publicadas pelas mídias sociais. Sob tal ótica, este trabalho terá por escopo analisar a falta de cautela do legislador no processo de elaboração da Lei 8.072/90, bem como encontrar critérios para definir um crime como hediondo, já que forma como tal diploma legal foi construído e é atualizado aproxima às diretrizes do direito penal do autor.
