The Effect of Treaties on Foreign Direct Investment

The Effect of Treaties on Foreign Direct Investment

  • Categories: Law

Over the past twenty years, foreign direct investments have spurred widespread liberalization of the foreign direct investment (FDI) regulatory framework. By opening up to foreign investors and encouraging FDI, which could result in increased capital and market access, many countries have improved the operational conditions for foreign affiliates and strengthened standards of treatment and protection. By assuring investors that their investment will be legally protected with closed bilateral investment treaties (BITs) and double taxation treaties (DTTs), this in turn creates greater interest in FDI.

The Evolving International Investment Regime

  • Categories: Law

With the growth of the global economy over the past two decades, foreign direct investment (FDI) laws, at both the national and international levels, have undergone rapid development in order to strengthen the protection standards for foreign investors. In terms of international investment law, a network of international investment agreements has arisen as a way to address FDI growth. FDI backlash, reflective of more restrictive regulation, has also emerged. The Evolving International Investment Regime analyzes the existing challenges to the international investment regime, and addresses these challenges going forward. It also examines the dynamics of the international regime, as well as a broader view of the changing global economic reality both in the United States and in other countries. The content for the book is a compendium of articles by leading thinkers, originating from the International Investment Conference "What's New in International Investment Law and Policy?"

This volume brings together significant contributions from leading voices in academia, the legal profession and government on the increasingly important topic of international investment and the legal system in which it operates. With the burgeoning size of international capital flows matched only by an explosion in international agreements intending to regulate the field, there is increasing potential for incoherence amongst and between treaties and arbitral decisions.Appeals Mechanism in International Investment Disputes compiles, compares and contrasts the analysis and arguments of the leading scholars, practitioners and government officials on the future of the international investment l...

The Rise of Transnational Corporations from Emerging Markets

Having undertaken billions of FDI in many continents and nations, between Argentina and the PRC, I consider Dr Sauvant s book an eye-opener, a new page, showing us a new super highway. The OFDI volume of emerging markets today, surpassing the entire FDI volume of not even 20 years back, is a signal of success of the free market economy. It signals also the end of privileges for the Europeans. It reflects entrepreneurship at its best on the part of the fast developing nations of Asia. It shows that free access to know how and capital has permitted Asia to catch up at an unprecedented speed. Contrary to often repeated but wrong opinions, the poor of the world have benefited the most by globali...

Reports of Overseas Private Investment Corporation Determinations

  • Categories: Law

This comprehensive two-volume work is a collection of determinations from OPIC, the US governmental political risk insurance provider, in the form of its Memoranda of Determinations from 1966 through to 2010. An important part of international investment law and policy is the political risk insurance coverage provided to international investors by their home states and multilateral organizations such as the World Bank. These programs are of crucial importance to the growth of international investment flows and the development of international investment law. The insurance claim decisions and as a result this area of international law has received disproportionately little attention. This ref...

This volume provides the first major holistic examination and interdisciplinary analysis of sovereign wealth funds (SWFs). SWFs currently hold three trillion dollars' worth of investments, almost twice the amount in all the hedge funds worldwide, and are predicted to hold nine trillion more by 2015. This relatively new and rapidly expanding phenomenon remains comparatively unregulated, but the International Monetary Fund and the G7 aim to establish temporary and voluntary rules to introduce transparency and uniformity until more permanent regulatory structures are instituted.

The UN celebrated its 70th anniversary in 2015. In the Volume Reforming the UN: A Chronology by Joachim Müller an exciting story is told describing the evolution of the UN through the main change initiatives applied by each Secretary-General, characterized by political confrontations, crises of confidence and organizational constraints. Initiatives included approving the Sustainable Development Goals, strengthening peacekeeping, enlarging the Security Council, establishing mechanisms to protect human rights, improving aid efficiency, and reforming management practices. This story is completed by a Chronology of Reform Events to enhance the transparency of parallel, multi-layer reform tracks. Lessons learned highlight the main drivers of changes, the interests and constraints, and the dynamics of the reform process: valuable insight for capitalizing on future change opportunities.

Investor-State arbitration is currently a much-debated topic, both within the legal community and in the public at large. In Towards Consistency in International Investment Jurisprudence, Katharina Diel-Gligor addresses the alleged proliferation of inconsistent decision-making in this field – one of the main points of concern raised in the ongoing discussions. After exploring whether such criticism is appropriate at all, she goes on to examine the different causes, forms, and manifestations of the inconsistencies that exist through a detailed analysis of ICSID arbitration. The author then canvasses possible approaches to reform and concludes that an ICSID preliminary ruling system – the practicalities of which are set out in the study – is a suitable means for enhancing consistency in investment arbitration and moving towards a jurisprudence constante.
