The Origins of International Investment Law

  • Categories: Law

International investment law is a complex and dynamic field. Yet, the implications of its history are under explored. Kate Miles examines the historical evolution of international investment law, assessing its origins in the commercial and political expansionism of dominant states during the seventeenth to early twentieth centuries and the continued resonance of those origins within modern foreign investment protection law. In particular, the exploration of the activities of the Dutch East India Company, Grotius' treatises, and pre-World War II international investment disputes provides insight into current controversies surrounding the interplay of public and private interests, the systemic design of investor-state arbitration, the substantive focus of principles, and the treatment of environmental issues within international investment law. In adopting such an approach, this book provides a fresh conceptual framework through which contemporary issues can be examined and creates new understandings of those controversies.

‘Such a good read’ Val McDermid What deadly secrets have been swept away by the flood? Heavily pregnant and a week away from maternity leave, Detective Sergeant Kate Miles is exhausted. But a violent hold-up at a local fast-food restaurant means that her final days will be anything but straightforward. When the closed case of a man who drowned in the recent summer floods is dumped in her lap, what begins as a simple, informal review quickly grows into something more complicated. Kate can either write the report that’s expected of her or investigate the case the way she wants to. As secrets and betrayals pile up, unsettling connections to her own past and family emerge. How far is Kate ...

"I wish to keep a record"

Nineteenth-century New Brunswick society was dominated by white, Protestant, Anglophone men. Yet, during this time of state formation in Canada, women increasingly helped to define and shape a provincial outlook. I wish to keep a record is the first book to focus exclusively on the life-course experiences of nineteenth-century New Brunswick women. Gail G. Campbell offers an interpretive scholarly analysis of 28 women’s diaries while enticing readers to listen to the voices of the diarists. Their diaries show women constructing themselves as individuals, assuming their essential place in building families and communities, and shaping their society by directing its outward gaze and envisioning its future. Campbell’s lively analysis calls on scholars to distinguish between immigrant and native-born women and to move beyond present-day conceptions of such women’s world. This unique study provides a framework for developing an understanding of women's worlds in nineteenth-century North America.

Miles Ferry's world is shattered by his dream girl's sudden death. There is only one remedy he can think of to help ease the pain of Kate's loss. His solution is desperate, radical, audacious, and certain to turn the whole world against him, but he is determined to act. He decides to embark on a cross-country tribute unsure if his journey will bring a sense of closure and all while being pursued by those intent on stopping him. The Ferryman is a story about love and redemption as Miles tries to stay one step ahead of failure. If he succeeds in reaching his final destination, he may find peace within himself and the strength to love again.

Time for the Appeal Tribunal in Investment

  • Categories: Law

This Thesis presents a proposal for building an effective, legitimate, and transparent judicial system in the investor-state dispute settlement through an appellate review mechanism for the awards of ad hoc arbitral tribunals. Current investment dispute settlement system includes the arbitration facilities provided by institutions such as ICSID and ad hoc arbitration tribunals agreed by the disputing parties. This Thesis argues that this scheme of investment arbitration lacks the mechanisms for correcting the legal errors and securing the consistency between arbitral awards for the similar issues of investment law. As a comparable mechanism, the WTO Dispute Settlement Mechanism is examined t...

Household Devils

On Halloween night, five young people are standing before a strange old building. It’s the epitome of a haunted house. It’s nestled between trees that arch towards it with branches like spindly fingers. It looks uninviting. It looks . . . evil. But that’s just fine. It’s what they wanted. It’s why they answered the advert — the one offering thrill-seekers the chance to spend All Hallows’ Eve in a haunted house. But there’s no reason for them to be scared, right? It’s all pretence, like a cheap fairground ghost train ride. Well, the Devil is in the detail, or so they say. Come inside . . . if you dare. “Aside from this being a solid horror read, fans of Hutchinson’s short stories will find their thirst well and truly quenched as in the frame of this dark tale are woven six shorts in the same vein as the author’s much-read Be Careful What You Wish For. A unique novel, darker than anything Hutchinson has published previously.”
