Without a doubt, the Qur'an is beautiful, indeed, the most beautiful literary composition the Arabic language has ever known. It signified the divine presence itself and commanded the greatest honor. The proof that the Qur'an was the word of God devolved upon the Qur'an itself. The Qur'an, Muhammad claimed with Qur'anic approval, indeed dictation, is so beautiful that it is inimitable; it is so inimitable that it is miraculous. It is therefore not the work of humans but of God. This character of the Qur'an is called its i'jaz. The Sunnah as concretization of the vision, or materialization of the ideal, translated theory into reality. In it, the values of Islam were given form and became alive. They throbbed with moving power. The Sunnah supplied the missing link between thinking and doing, between ideational apperception and action, between thought and life and history.
A sea change has taken place in Islamic legal studies. This book both reflects and contributes to that change. Traditionally, scholars in this field have tended to focus on law as a body of rules and doctrines, as 'fiqh'. This volume is more interested in how the law has been applied to concrete situations. It looks at judicial decision-making, legal responses (fatwas), customary practices, the actions of public inspectors, cultural contexts, and theological discourses as well as modern legal reform and constitutional development. This book is the result of the first interdisciplinary conference in Vietnam which took place on "the Rule of Law." Instead of beginning immediately with a highly specialized debate from the perspective of one single academic discipline, we started to discuss numerous facets of the subject arising from a multidisciplinary dialogue. For this reason, the contributions for this publication come from various scientific disciplines in Vietnam and Germany: political, historical, social, economic and legal sciences, but also members of Vietnamese governmental and non-governmental organizations. The aim of the volume is to open up a dialogue about the Rule of Law between two very different legal cultures, the German-European and the Vietnamese-Southeast Asian.
