Considerada uma marca não tradicional, a marca de posição já contava com a possibilidade de concessão em outros escritórios de propriedade industrial no mundo, mas no Brasil não se permitia seu registro, apesar de ser uma marca visualmente perceptível e, em tese, ser compatível com o disposto na Lei nº 9.279 de 1996.
