A palavra "risco" é usada com mais do que um sentido em relação ao contrato de venda. O risco pode ser risco contratual, risco económico, risco de mercado, risco de preço, risco da prestação ou da contraprestação, mas também risco de perda, deterioração ou perecimento das mercadorias. De acordo com o que procuro defender, na venda internacional de mercadorias nem todos os detalhes relativos à transferência do risco são identificáveis com o olhar dirigido apenas a este contrato. Outros contratos, como o contrato de transporte, o contrato de seguro ou os créditos documentários permitem identificar um concreto risco no contrato de venda quando está em causa “transferência do risco” e delinear melhor o critério para a sua alocação. Um lapso de detalhe na criação do critério para a transferência do risco permitirá uma alocação ineficiente, com consequências desastrosas.
