Con l’ambizione di accomunare in un’unica riflessione, seppure condotta da diverse prospettive di osservazione, due discorsi – quello sui valori e quello sulle tecniche – che spesso tendono a procedere per vie separate, il volume raccoglie i testi rielaborati delle relazioni tenute al Convegno Valori e tecniche nel diritto del lavoro svoltosi a Firenze il 20 e 21 settembre 2019. L’opera è suddivisa in quattro sezioni – I valori del diritto del lavoro, I poteri del datore di lavoro e i loro limiti, I licenziamenti, I contratti non standard e flessibili – e ciò spiega la diversità degli approcci tematici ma anche le utili sovrapposizioni tra i contributi e la ricorsività di alcuni temi, primo fra tutti quello del licenziamento.
L’introduzione al volume assume i tratti rapidi della presentazione delle caratteristiche dell’opera, piuttosto che i contenuti sistemici dell’analisi della riforma Monti-Fornero, perché funge da apertura a un volume collettaneo nel quale l’analisi di ciascuno dei molti istituti nei quali si articola la legge 92 affianca, al lavoro di stretta esegesi, una prima lettura sistematica delle nuove discipline.
Starting from the assertion that crisis is part of the essence of labour law, this volume brings together researchers in the field who accepted the challenge to critically reflect on this branch of the discipline. As the COVID-19 pandemic has had a global impact, labour law across the world must come to terms with a new reality. In this context, it would be prudent to adapt to new circumstances by taking known paths. To this end, this book reflects on what effectively constitutes labour law, considering questions which are not usual within labour law. Insights from philosophical, sociological and even economic standpoints are mobilised to reconcile the past with the future of labour law.
Regulations affecting 10 areas of everyday business are measured: starting a business, dealing with licenses, employing workers, registering property, getting credit, protecting investors, paying taxes, trading across borders, enforcing contracts, and closing a business. 'Doing Business 2008' updates all 10 sets of indicators, ranks countries on their overall ease of doing business, and analyzes reforms to business regulation - identifying which countries are improving their business environment the most and which ones slipped. The indicators are used to analyze economic outcomes and identify what reforms have worked, where and why. 'Doing Business 2008' focuses on how complex business regulations dampen investment, growth and job creation in all businesses, and especially opportunities for women entrepreneurs.
