German Administrative Law

  • Categories: Law

It is with the greatest pleasure that I add a few introductory remarks to the book of Dr. Mahendra Pal Singh on German administrative law. Between 1981 and 1982 Dr. Singh spent nearly two years in Heidelberg, doing re search partly at the South Asia Institute of the Ruprecht Karl University and partly at the Max Planck Institute for Comparative Public Law and International Law. During his stay in the Federal Republic of Germany, Dr. Singh studied the general principles of German administrative law in a careful and admirable manner, and he has now completed the present book which is based on his studies in Heidelberg. For several reasons Dr. Singh is especially qualified to write this book: His famil iarity with the administrative law of his home country has enabled him to look upon the German law with considerable objectivity; his knowledge of the German lan guage gave him access to the vast amount of German literature and court decisions; and Dr. Singh was able to penetrate this material with a searching and scholarly spirit. The final product seems to be the first comprehensive treatise in English on German administrative law.

The Indian Legal System

Présentation de l'éditeur : "The proposed book is an attempt to understand the existence of multiple non-state legal traditions despite the presence of a uniform legal system in India. There is a significant gap that exists between the state-legal system and the practices and preferences of people belonging to different communities. In order to understand this structure, the book goes back to the history of legal system in India and tries to identify the reason behind the prevalence of thesealternative modes. It studies some prominent legal systems of pre-colonial India like the Mughals, and further explores the way Indian legality was transformed during the British rule. The study maps the evolution and growth of the common law system in India and takes into account the factors thatcontributed to the strengthening and acceptance of this system."

The last decade of the nineteenth century witnessed, for the first time, the demand for a federal polity premised on the principle of linguistic provinces. The regional Chambers of Commerce in the Telugu, Bengali and Tamil linguistic regions were the first to put forth such a demand before the Congress and the colonial state. The Indian National Congress agreed to it in 1920 and reorganized provincial Congress organizations, which had been earlier based on politico-administrative boundaries of the British Indian provinces, on linguistic lines under a new party constitution under Gandhi's influence. However, once it came to power at the Centre in 1947 the national Congress leadership changed ...

International organizations are increasingly operating across borders and engaging in legal transactions in virtually all jurisdictions. This makes, familiarity with the applicable law and practice imperative for both international organizations and those who engage in legal relations with them. Furthermore, the issue of whether, how, and to what extent domestic courts take into account decisions of foreign and international courts and tribunals in their own decision-making has become increasingly important in recent years. This book provides a comprehensive empirical study of this transnational judicial dialogue, focusing on the law and practice of domestic jurisdictions concerning the lega...
