This book presents principal controversies over the determination of death by neurologic criteria (“brain death”). The editors and authors are exceedingly well-versed in this subject and are on the forefront of the current debates. Many of the topics feature pro-con debates, allowing readers to consider the merits of the arguments and decide their own position. Collective Ijtihad

  • Categories: Law

THE CONTEMPORARY postnormal world is posing for Muslims ever strange ethical, financial, and medical dilemmas for which modern jurists are expected to provide a suitable theological response. Yet even with an encyclopedic knowledge of Islamic law, the task facing them is daunting. In the real world this level of complexity has led to chaos in fatwa issuance with many scholars voicing concern at the direction to which things are moving and calling for the process to be regulated. This book critiques fatwa issuance in the modern context and calls for application of a synthesized approach using the mechanism of collective ijtihad to formulate rulings and overcome current weaknesses. It carefull...

Contemporary Bioethics

This book discusses the common principles of morality and ethics derived from divinely endowed intuitive reason through the creation of al-fitr' a (nature) and human intellect (al-‘aql). Biomedical topics are presented and ethical issues related to topics such as genetic testing, assisted reproduction and organ transplantation are discussed. Whereas these natural sources are God’s special gifts to human beings, God’s revelation as given to the prophets is the supernatural source of divine guidance through which human communities have been guided at all times through history. The second part of the book concentrates on the objectives of Islamic religious practice – the maqa' sid – which include: Preservation of Faith, Preservation of Life, Preservation of Mind (intellect and reason), Preservation of Progeny (al-nasl) and Preservation of Property. Lastly, the third part of the book discusses selected topical issues, including abortion, assisted reproduction devices, genetics, organ transplantation, brain death and end-of-life aspects. For each topic, the current medical evidence is followed by a detailed discussion of the ethical issues involved.

Overcoming Orientalism

Overcoming Orientalism

Orientalism is the term applied to scholarship that reduces Islam and Muslims to stereotypes of ignorance and violence in need of foreign control. It has been used to rationalize Europe's colonial domination of most of the Muslim world and continued American-led interventions in the post-colonial period. In the past 30 years it has been represented by claims that a monolithic Islam and equally monolithic West are distinct civilizations, sharing nothing in common and, indeed, involved in an inevitable clash from which only one can emerge the winner. Most recently, it has appeared in Alt Right rhetoric. Anti-Muslim sentiment, measured in public opinion polls, hate crime statistics, and legisla...

Islamic Bioethics: Current Issues And Challenges

The chapters take both theoretical and practical approaches to the topic, and each covers an emerging issue in Islamic bioethics. This book will be use...

Islamic Finance in Europe

Highlighting the impact of current globalization on financial markets, this topical book challenges the universality of Western property rights and interprets Islamic finance in Europe as part of a plural financial system, where different conceptions of economic justice(s) co-exist and influence each other. The contributing authors analyse key economic development and social integration issues from an Islamic perspective and outline the European approach to accommodating Islamic finance, with particular regard to the peculiarities of individual nation-states. Set in this context, the book presents financial pluralism as a device to enhance a level playing field in the global marketplace, as well as to foster a plural open society. Providing a comprehensive and methodological guide to Islamic finance in Europe, this book will prove an illuminating and informative read for academics, students and policymakers with an interest in the impact on financial regulation of an increasingly globalized world.
