Discursive Constructions of Consent in the Legal Process

Discursive Constructions of Consent in the Legal Process

As a linguistically-grounded, critical examination of consent, this volume views consent not as an individual mental state or act but as a process that is interactionally-and discursively-situated. It highlights the ways in which legal consent is often fictional (at best) due to the impoverished view of meaning and the linguistic ideologies that typically inform interpretations and representations in the legal system. The authors are experts in linguistics and law, who use diverse theoretical and analytical approaches to examine the complex ways in which language is used to seek, negotiate, give, or withhold consent in a range of legal contexts. Authors draw on case studies, or larger research corpora or a wider sociolegal approach, in investigations of: police-citizen interactions in the street, police interviews with suspects, police call handlers, rape and abduction trials, interactions with lay litigants in a multilingual small claims court, a restorative justice sentencing scheme for young offenders, biomedical research, and legal disputes over contracts.

Vulnerability, the Accused, and the Criminal Justice System

  • Categories: Law

This book is concerned with the vulnerability of suspects and defendants in criminal proceedings and the extent to which the vulnerable accused can effectively participate in the criminal process. Commencing with an exploration of how vulnerability is defined and identified, the collection examines and analyses how vulnerability manifests and is addressed at the police station and in court, addressing both child and adult accused persons. Leading and emerging scholars, along with practitioners with experience working in the field, explore and unpack the human rights and procedural implications of suspect and defendant vulnerability and examine how their needs are supported or disregarded. This volume of the Journal of Police Studies reflects on theoretical developments concerning police. The book is focused on a paper by Jack R. Greene, titled The Tides and Currents, Eddies and Whirlpools and Riptides of Modern Policing: Connecting Thoughts. The paper was the outcome of a seminar organized at Ghent University in the framework of the working group on policing of the European Society of Criminology (ESC), held in September 2010. Greene's contribution refers to original background papers which were published earlier. This book pushes the analysis further, Ã?Â?starting from the observations Greene makes in his provocative roundup. The book's themes include: collective action an...
