Pese embora a prova por reconhecimento sustente, com frequência, a convicção do julgador em relação à autoria dos delitos, nem sempre conduz a resultados credíveis, quer em razão da vulnerabilidade da memória a múltiplas influências externas, quer em virtude de uma certa permeabilidade deste meio probatório ao incumprimento do esquema procedimental a que o legislador sujeitou a sua produção. Foi a constatação destes problemas, associada ao advento da inteligência artificial, que despertou o interesse na procura de modernas diligências identificativas. Nesta senda, no presente estudo, equacionámos a utilização da tecnologia de reconhecimento facial como ferramenta destinada a esclarecer, no processo-crime, a identidade do autor da infração penal.
Prova por Privados - Da Admissibilidade em Processo Penal de Meios de Prova Obtidos por Particulares
Todos os dias surgem casos de demonstração de delitos com base em elementos trazidos por privados, sejam fotografias, vídeos, ficheiros informáticos, entre muitos outros. A lei portuguesa não dá solução genérica à questão de saber se tais elementos são admissíveis como prova de crime. A resposta obtém-se examinando se as regras probatórias vinculam os privados, e em que termos, sendo fundamental apurar o sentido e o regime das proibições de prova. É também imperioso compreender que interferência tem na questão o juízo sobre a ilicitude penal substantiva, e se a conclusão pela justificação de um acto típico implica a aceitação num processo da prova que por ele se haja obtido. This monograph is the first to identify an important theoretical overlap between Anglo-Saxon and Lusophone postcolonial theories: the systematic neglect of gender and sexual variables in the analysis of the marketing of cultural difference in the post colonial era. Drawing on the theoretical work of Graham Huggan and Boaventura de Sousa Santos, the author of this study discusses the political significance of this neglect by focusing on the asymmetrical positions occupied by two widely acclaimed Lusophone women writers, Paulina Chiziane of Mozambique and Lídia Jorge of Portugal.
