Coercive Diplomacy, Sanctions and International Law

  • Categories: Law

This volume explores sanctions as instruments of coercive diplomacy, delving into theoretical arguments and combining perspectives from international law and international relations scholars and practitioners. Primary questions include the compatibility and legitimacy of sanctions regimes, enforcement measures, including the role of sanctions committees, the practice of circumventing sanctions, and the relation with the ICC proceedings. Legal and institutional aspects of the practice of the European Union are addressed. The extraterritorial effects of national legislation implementing sanctions imposed by individual States are investigated. A focus is on the impact of sanctions on non-State actors. The connections with the protection of human rights and the adverse impact on individual rights are considered. The implementation of sanctions is addressed in view of their legal limitation and the concept of proportionality, their consequences upon existing treaties and contracts, their effectiveness, and their strategic implications.

The authors’ analysis provides a representative case study of how this informal source operates alongside and in the absence of other sources of applicable law. The contributions are divided into two parts, devoted respectively to substantive principles and procedural ones. In recent years, the tendency has been to settle international disputes by informal methods. Among those methods conciliation has seen a successful revival, after many years of decline, in the case of Timor Leste v. Australia while inter-State complaint proceedings under the UN-sponsored human rights treaties have unexpectedly reached their merits stage of conciliation. The present book takes stock of these developments by portraying, at the same time, the potential of the OSCE Court of Conciliation and Arbitration which still remains to be fully activated. Additionally, the contributions reach out to geographical areas in Africa and Asia. An analysis of the relevant procedural mechanisms completes the study to which 14 authors from nine different countries have contributed. See inside the book.

This edition of the Practical Commentary on the Rules of the Chamber of Arbitration of Milan explains article by article the new CAM Arbitration Rules that came into force on 1 March 2023, in light of the changes introduced by the Cartabia Reform. The authors aimed to create a practical textbook that offers explanatory interpretations and useful suggestions for users regarding each provision of the Rules. What particularly distinguishes this work from other commentaries on the rules of other arbitral institutions is the series of short notes, in the form of “examples” and “tips”, accompanying almost every article commented on. In addition to its practical approach, this Commentary does not shy away from providing an in-depth theoretical and scientific analysis through special “Focus” cards, some of which are specifically dedicated to the legal innovations brought by the Cartabia Reform to Italian arbitration.
