Apesar da sua importância indiscutível, o respeito pelo princípio da igualdade das partes afigura-se de difícil compreensão no momento da constituição do tribunal arbitral, quando haja pluralidade de partes. Existe, com frequência, um conflito que se estabelece entre este princípio e a mencionada constituição, conflito que tem revelado alguma fragilidade da arbitragem face aos tribunais estaduais, a ponto de muitos questionarem se não deverá recorrer-se à jurisdição estadual (e desistir da arbitral) em caso de pluralidade partes. Neste sentido, o objecto do presente trabalho consiste em apurar se, nos termos da LAV, a arbitragem consegue dar ou não uma resposta adequada ao problema que enunciamos, afirmando-se como um verdadeiro meio de resolução alternativa de litígios.
