Omissão imprópria e dolo eventual são dois assuntos que, há muito, suscitam calorosos debates acadêmicos e práticos. Atualmente, considerando o grande desafio que o Direito Penal enfrenta na análise de condutas desempenhadas em meio às complexas estruturas empresariais, as quais geram problemas de imputação objetiva e subjetiva, observa-se que as controvérsias a respeito desses temas se apresentam de forma ainda mais intensa. É nesse contexto que esta obra está inserida, propondo-se a investigar uma possível incompatibilidade entre omissão imprópria e dolo eventual. A relevância desse assunto para a prática jurídica atual pode ser observada, por exemplo, a partir de dois recentes casos de rompimento de barragens de mineração no Brasil – casos de Mariana e Brumadinho, em Minas Gerais –, nos quais a pretensão punitiva estatal para responsabilização penal das pessoas físicas supostamente implicadas nos fatos é ancorada, justamente, nos conceitos de omissão imprópria e dolo eventual.
